PPO rejects the application against the director of the Anb for counterfeiting and use of a document with false content

After a fully proceeded procedure and checks carried out, the Public Prosecutor of the Basic Public Prosecutor’s Office Skopje adopted a decision to reject anonymous reports against the Director of the National Security Agency (ANB) for the crimes of falsifying a document and the use of a document with false content.

The Public Prosecutor’s Office of the Republic of Macedonia announced today that the reports were referring to publicly published data according to which the suspect in applying for positions director of the PE « City Parking » – Skopje, Assistant at the Faculty of Security at Ss. Kliment Ohridski University – Bitola and Director of the National Security Agency (Anb) Bulgaria, which, according to the complainant, did not conduct testing for the TOEFL IBT, nor did it issue internationally recognized certificates required on the advertisements.

Acting on the report, to investigate such allegations, the statement added, the competent public prosecutor immediately after the establishment of the case in November 2024 made a request for international legal aid to the Republic of Bulgaria to obtain the necessary data and evidence for the legal entity Language School Julia Co. The manager, what activity is performing, whether he is certified as a center for passing and issuing internationally recognized foreign language certificates, which and for what period, as well as whether a certificate of knowledge of a foreign language knowledge has been issued for the reported legal entity. At the same time, the Government of RSM was requested the entire file that was formed for the person related to the announcement for the selection of the Director of Anb in 2024 and the accompanying documentation.

– According to the response from the Bulgarian competent authorities submitted in March 2025, the request for international legal aid in Bulgaria was acted by the District Public Prosecutor’s Office Plovdiv, which after checking the checks that the legal entity Language School Julia Co.LTD was registered in the commercial registry as  » translation activity, translation services and legalization documents and organization of private language schools. Complete data on the manager of the legal entity were obtained and an invitation was invited to appear as a Witness and to comment on all questions of the shutout. But the Bulgarian Interior Ministry checks have shown that the owner has been out of Bulgaria for a long time. For these reasons, the request for international legal assistance by the Bulgarian authorities has not been fully carried out and has been returned to the Macedonian prosecution, with an addition to obtained documentation – the Public Prosecutor’s Office of the Republic of Macedonia said.

After this, the competent public prosecutor continued his checks and obtained the documentation from the complete file for the applicant from the Ss. Kliment Ohridski University – Bitola and PE « City Parking » – Skopje.

– After inspecting the full documentation by all institutions where the applicant applied, it was concluded that among other documents he submitted a Certificate from School of Foreign Languages ​​Julia Co. Ltd with e-EENG 23.03.2022-Course for preparation for the toefl exam, as well as a Certificate of Passed the TOEFL IBT of 26.03.2022 with 75 points, which concludes that the passing was carried out at home through the Bulgaria Examination Center. This certificate issued by ETS visually, by form and content, differs from the certificates submitted in addition to the criminal charges, which stated that they have been issued by the legal entity Language School Julia Co.ltd – the Prosecutor’s Office.

The Public Prosecutor also checked the publicly available data in ETS-The Education and Testing Service, such as the only organization that is an international ToEFL certification tester, whereby the ToEFL IBT testing manual for 2022-2023 is evident that it was evident in that period. conditions. In that case the exam was monitored online by a man – supervisor, and in content and form the test is the same as the one passed in a licensed exam center.

– The difference is that the toelf IBT domestic ideas could have been taken at any time, four days a week, after prior registration. The results and the test certificate are available in electronic form 6-10 days after testing through the user profile of the person who has passed the test, and if more than two years have passed since the passage, as in this case, ETS cannot provide notice or verify the results and the test-the statement said.

After the fully conducted checks, the public prosecutor stated that in the said case, the suspect did not make a false document with the intention of using such a document as a real and did not use a forwarding document, nor as evidence in legal traffic, used a document, a book or a script that he knows. The attached certificate in accordance with the disposable evidence, the statement said, was issued after the toefl IBT test at home during 2022 and it differs from the certificate issued by Language School Julia Co.ltd.

Pursuant to Article 122 of the Criminal Code, the Prosecutor’s Office said, a document is every case that is eligible or specific to serve as evidence of a fact that has a value in legal relations.

– Hence, even if there is a dilemma about the credibility of the document for the Final Preparation Course for the toefl exam issued by the Language School Julia Co.ltd, he did not have a legal consequence, nor was any other meaning for legal relations and the name of the director. For these reasons, the acts of the applicant do not contain the elements of the reported crimes – reads the statement.

The Public Prosecutor checked the allegations in the reports and in the same person’s certificates, obtaining all the documentation from the Faculty of Economics at the University of Skopje, the subject of the State Commission for the Prevention of Corruption and the Report of the Extraordinary State Education Inspectorate.

– Given all this evidence, the public prosecutor stated that even such allegations did not fulfill the crime – said the Public Prosecutor’s Office of the Republic of Macedonia.
