Police began criminal proceedings in September last year following the dead child’s mother’s application.

The criminal proceedings, in which the BKUS had no neglect and inaction, has been terminated because there was no criminal offense, the police said.

At the same time, the police are continuing an investigation into another criminal proceedings in which last year the deceased boy’s parents for two other children, who were also not vaccinated and were affected by diphtheria, from the hospital, the police said.

It has already been reported that a four -year -old boy who was not vaccinated against the disease died after diphtheria on September 16 last year. Later, police arrested the boy’s parents for two other children, who were not vaccinated and were ill with diphtheria, removing from the hospital, while the children were taken back to the hospital.

Both parents have suspects in active criminal proceedings and are investigated by the Criminal Law article for deliberate leaving a person without assistance in a life or health in a dangerous condition and has no ability to maintain himself in minority, illness or disability if the perpetrator had the opportunity to provide the victim and

It is also reported that after the boy’s death, the attention was drawn to the activities of the doctor Edgar Mednis, when he actually began to blame the boy’s hospital doctors. After the death of the boy, Mednis said Telegram said parents of their patients have used the rights prescribed by their patients with diphtheria and decided to give up their daughters’ further treatment because they concluded that « the health and life of the daughters could be harmed, as happened to the brother.

Such a target against the attending medics called the ASU Children’s Hospital’s backlash, calling on the various institutions to assess the action of the Mednis.

In December last year, the Latvian Medical Association (LAB) Certification Council decided to cancel both medical certificates – a pediatrician and homeopath. Later, Mednis appealed the decision by the Council to the Ministry of Health, while the ministry left it unchanged. Now the Mednis has been to the court.

In accordance with the applicable regulation, if the doctor challenges the deprivation of the certificate, the decision on its cancellation shall be suspended and the certificate must be renewed until the doctor exercises his right to appeal the unfavorable decision in all three courts.

The LAB board also asked law enforcement agencies to assess whether Mednis’ public statements on social networks did not see the possible speech of hate. The VP refused to initiate criminal proceedings against the Medni following applications received from the Health Inspectorate and the Children’s Hospital for possible defamation to the hospital and its staff. Also at the Riga Northern Prosecutor’s Office, when assessing the LAB, the application decided not to initiate criminal proceedings.

The VP has taken such a decision, stressing that the Criminal Law is liable for defamation to the other person, not against the institution or company. The prosecutor’s office, on the other hand, assessed that doctors were not a particularly protected group, accordingly the defamation was resolved in civil litigation, not in criminal proceedings.
