Parliament restricted the election of MAPAS Expert Council members to two terms

The Assembly adopted the Draft Law on Amending the Law on Compulsory Fully Funded Pension Insurance, shortened by a shortened procedure. However, these amendments meet the selection of members of the Council of Experts at the Agency for Supervision of Fully Funded Pension Insurance.

-The President and the four members of the Agency’s Council of Experts are appointed and dismissed by the Parliament of the Republic of Northern Macedonia on the proposal of the Government of the Republic of Northern Macedonia. Given that the mandate of the members of the Council of Experts is five years, with the possibility of re-election, there is a need to specify this provision in the sense that the mandate of the President and the members of the Council of Experts is five years and no member may be in that function more than two consecutive mandates.

SDSM MP Jovanka Trenchevska reacted to the adoption of these changes, which noted that in this way retroactive action was allowed and legal certainty is being violated.

-Article 1 of these amendments amends Article 50 paragraph 4, ie the mandate of the President and the members of the Experts Council of the Agency, which is five years, in two consecutive elections, and that is okay, I think that 10 years is enough for an official to be in a specific function. But what is disputed is that this Article 1 is related to Article 4 of the draft amendments to the Law, which states that by the day of entry into force of this Law, the mandate of the members of the Agency’s Council of Experts who fulfill the requirement of Article 1 of this Law- said Trenchevska.

He added that this grossly violates the constitution, ie its Article 52 paragraph 4, which states that laws and other regulations may not have a return effect unless it is more favorable. This, Trenchevska said, creates a disadvantage with disadvantage and it creates legal uncertainty.

VMRO-DPMNE MP Bojan Stojanovski, who noted that the members quoted Trenchevska quoted them, or did not understand them, or a legal solution that is not the same as what is on the agenda of the session, or as he said, at worst.

The information is not true, not to say it is false, that this legal solution will cease the mandate of all members of the Council of Experts, but only to the gentleman who has little forgotten – said Stojanovski.
