Paid after he had raped his son. It is the decision given by the Court of Appeal (CA) Alba Iulia in the case of a man sentenced in the first instance to 8 years in prison for rape on his son.

According to the short solution published on Monday, on the portal as Alba Iulia, the court admitted the appeal made by the defendant and rejected, as unfounded, the appeals made by the Prosecutor’s Office attached to the Alba Iulia Court and the injured person, through a legal representative, against the criminal sentence pronounced by the Alba Iulia Court in May 2024.

« It abolishes in full the criminal sentence challenged and proceeding to a new resolution of the case: (…) pays the defendant (..) in the aspect of committing the crime for which he was sent to court – rape, (…), as the deed does not exist, » is mentioned in the solution.

At the substantive court, the Alba Iulia Court, the man was sentenced to 8 years in prison for committing the crime of rape.

The main agent of the Alba Passport Passport Public Service, the man was preventively arrested in March 2022 by the Alba Iulia District Court, being accused of raping his son.

According to a statement sent to the press at the time by the Prosecutor’s Office attached to the Alba Iulia Court, during 2021, the defendant, « taking advantage » of his son’s age, 5 years at the time of facts, « repeatedly, maintained oral sexual relations (put on the minor to exercise such sexual intercourse on him, respectively).

The same source showed that the facts would have taken place in a room of the family’s house in Alba Iulia, where they closed under the pretext that they play a game entitled « Prison ».

« In the same circumstance in which oral sexual relations were held, the defendant showed his minor son, using the mobile phone, pictures in which they appeared male naked and exposed their sexual organs, » the prosecutors said.

The agent was old at work for over 15 years.
