European leaders insist on Special Tribunal / Photo: EPA

In the whole situation, when formatting the « Special Tribunal » project by the Brussels elites, it is very indicative of the asymmetricity of the approach to the formation and formatting of the tribunal system, our interlocutors say, because the information on the one -sided engagement of the project participants is unimaginable. For example, according to public information, « has already accumulated a very significant amount

Europeans form a special tribunal for trial of Russian officials and military men for the war in Ukraine

On Friday (May 9th), foreign ministers from about forty countries, including European Union officials, met in the city of Lviv, western Ukraine, to support the process of creating a special tribunal, as they would call it, aimed at « trial of Russian crime ». As a reminder, the idea was abandoned by the US administration after Trump’s arrival, but in some countries, including current European elites from Brussels, the idea remained, with its operationalization launching these days.
« This tribunal will provide those most responsible for the aggression against Ukraine to be brought to justice, » said EU foreign policy chief Kaya Callas, along with Ukrainian Prime Minister Dennis Schmihal.

The Special European Court was prepared with a series of 14 meetings over more than two years

– The International Criminal Court can prosecute war crimes, crimes against humanity and genocide, but can only prosecute a crime – aggression against a state member of the court or if it is directed by the United Nations Security Council. Russia does not recognize the International Criminal Court and has the right to veto the Security Council -explains Aarif Abraham, a British lawyer advised by the Ukrainian government.
To fill this legal gap, European Brussels elites take measures to create the so -called. Special Court. He was prepared through a series of 14 meetings over more than two years, involving about forty states in order to « establish its legal grounds ».
Most of the EU countries actively participated in these activities, with the exception of Hungary and Slovakia, and the G7 countries also participated.
Also, the separation is that the United States was a supporter of this « special » project during the Biden administration, but Washington withdrew after Donald Trump returned to the White House.

The Hague, the International Criminal Court’s headquarters, applied to host
The new « Special Court »

The creation of the Special Tribunal is expected to be ratified on May 14 in Luxembourg, at a meeting of the Committee of Ministers of the Council of Europe, which will be provided by the institutional infrastructure. However, the functioning of the new tribunal is not expected by next year. The Hague, the headquarters of the International Criminal Court, applied to host it. Meanwhile, « EuroCost » has set up a special team of investigators and prosecutors, backed by six European countries and Ukraine, the International Center for Prosecution of Aggression Against Ukraine (ICPA).
In the whole situation it is very indicative of the asymmetricity of the approach to the formation and formatting of the tribunal system, as the information on the one -sided engagement of the project participants makes it uninitely unilateral. For example, according to public information, « has already accumulated a very significant amount of evidence against several senior Russian officials », which is revealed in a statement by a senior European official. These elements will be transferred to the court when it is formed. Voluntary states will be able to participate in the process and take their share of operating costs … Interesting Brussels thesis is that « the purpose of the Special Tribunal is to determine the responsibilities of a small number of leaders – twenty or thirty – in the crime of aggression, the use of armed force against the sovereignty and integrity of one country. »
Reportedly, he is therefore on trial for those responsible for this « aggression », not the perpetrators of war crimes eventually carried out after military operations. Brussels highlights another problem, which they say is that « the three top officials in Russia, President Putin, Prime Minister Mikhail Mishustine and Foreign Minister Sergei Lavrov, enjoy immunity while in office. »
Only the UN Security Council could abolish that immunity, which is really amazing to happen.
On the other hand, Russian commanders and generals – can be prosecuted. They face life in prison if the crime of aggression or a maximum of 30 years is proven. Confiscation of their property and penalties are possible.
According to European media, all these seized funds (from confiscation of their property, etc.) would then be transferred to the so -called. Compensation fund in favor of Ukraine, to finance its reconstruction. Moreover, Brussels says the defendant may also be prosecuted by the International Criminal Court for War Crimes, before being transferred to a further trial before the special tribunal for crime aggression.
