A Turkish host from Goldau fights for the Swiss passport in front of the Federal Supreme Court and triggers a debate about the practice of the State Secretariat for Migration. Expert Frank Urbaniok draws an unexpected position.
The public prosecutor condemned the driver by punitive order because he drove a car « in a rescue ». Anyone who causes an accident is negligent. He should have recognized the signs of fatigue and had to do without the trip.
The man received a conditional fine with a trial period of two years and a bus of CHF 900. This was associated with an entry in the criminal register. This came at an unfavorable time – during its ongoing naturalization procedure.
He came to Switzerland at 28 as a political refugee
The host comes from Turkey. At a young age he was a member of an illegal left party and took part in demonstrations. That is why the Turkish judiciary sentenced him to 12.5 years in prison. He fled to Switzerland at the age of 28. That was in 1994. He received asylum two years later. Switzerland recognized him as a political refugee. With his wife he has two sons who are currently working as a secondary teacher and on a job agency office.
To this day, he is afraid of repression from the Turkish state when he goes on vacation in his old home. Therefore, his name does not appear in this text. During a visit to his restaurant, he agreed to be photographed. But he doesn’t want to pose. The photographer should simply show him as his guests see him: at work.

Frank Urbaniok is a forensic psychiatrist and judged thousands of offenders in his career. In his controversial book « Side of the migration »that started in 1st place on the bestseller list of paperbacks.
In it he demands 17 measures against foreign crime. Switzerland should naturalize fewer people from nations who stand out negatively in crime statistics. This includes Turkey. People with this origin are more accused of Swiss in Switzerland. Urbaniok justifies this with cultural characteristics.
In the statistics, the host from Goldau also appears as a criminal foreigner. So is it consistent that the migration authority has stopped its naturalization?
Urbaniok’s answer is not the way you would expect. In this case, he describes the hard course of the authority as « disproportionate ». Because the man did not commit a serious crime.
Urbaniok sees a fundamental problem: “Taking those who are actually easy to touch is much easier than showing clear edges that cause real problems. So it is often: we like to control and solve what is easy to control and solve instead of what is important and difficult. »

But the host from Goldau will take a seat in the Palace of Justice that day. He also wants to get to know a special feature of the highest Swiss court. The fact that Judges would carry out their differences in opinion in front of an audience would be unthinkable in Turkey.
How the verdict will be canceled personally no longer plays a role for the host because the procedure has taken so long. The five -year period will take place in August. Then he will be able to celebrate his naturalization anyway.
Nevertheless, he sticks to his complaint. He says: « Maybe I can help others in the same situation. »
