Mosobladu approved the bill on compensation landscaping during the cutting of trees

The Moscow Regional Duma adopted in the first reading a bill introducing a compensation landscaping mechanism in the region. The laws by which companies should receive cutting tickets and plant trees instead of cut down, were adopted, for example, in Moscow and Sevastopol, but there were still no them in the suburbs. The project is accepted at the request of the local prosecutor’s office, where they noticed that the construction rate in the region continues to increase, and the developers are not required for the cutting of greenery.

The 13-page bill “On the Protection of Green Plantings” was submitted to the Moscow Regional Duma by the prosecutor's office of the Moscow Region. The document consists of six articles: they define the concept of compensation landscaping as “reproduction of green spaces to replace the destroyed or damaged”, the need for compensation and receipt of permits for deforestation (cutting tickets) in the near Moscow authorities. Ten types of cutting are stipulated, including for construction, in the bastards of the lifting of linear facilities and sanitary.

The project states that when cutting trees and shrubs, the owner of permission for this must land the same equal green spaces or more – in area, quantity and “values ​​of the species composition”.

The landing should be carried out at the place of cutting down, and in the absence of a place – on the site determined by the authorities. Finally, “reimbursement of compensation value” by citizens, legal entities and individual entrepreneurs is allowed. Its methodology has to be approved by by -laws.

The explanatory note states that in 2024 the administration of some cities of the Moscow Region (for example, Krasnogorsk) adopted regulations for cutting down green spaces, in which the warranty tickets were excluded from the necessary list of documents for developers. “A situation is created in which the developer does not bear the obligation to compensate for the damage caused to cutting trees during work,” the note says.

The representative of the regional prosecutor's office, Natalya Mikhina, recalled at the hearing in the Moscow Region that the region acts as one of the Russian leaders “on the pace of housing input” and, in these conditions, it is important to maintain the “ecological component” of the Moscow Region. The explanatory note says that similar laws are in force in many regions-for example, in Moscow, St. Petersburg and Sevastopol. For the Moscow Region, Mrs. Mikhlina called the document new, asking it to approve for « continuing work. » The mos controludes had no objections.

It should be noted that since 1999, a local law has been in force in Moscow on the protection of green spaces, which stipulated compensation landscaping. In November 2024, instead of it, the law “On the Protection and Use of the Green Fund” was adopted.

In the explanatory note to it, the mechanism of compensation landing is called outdated; In the All -Russian Society, nature protection believed that “in the conditions of a limited area” of the city, this mechanism leads to the fact that “in return for full -fledged trees, seedlings are planted or compensation is not carried out at all” (see “Kommersant” dated November 14, 2024). The new mechanism of compensation landscaping in Moscow is proposed to be installed by an by -laws.

The expert of the Public Council under Rosleskhoz Anton Khlynov says that social activists in the suburbs already several years ago proposed to adopt a similar bill and he considers the prosecutor's office to be constructive about the adoption of “systemic norms”. Mr. Khlynov welcomes that the document enshrines compensation landscaping as mandatory and establishes the criteria: “If something was cut down in Khimki, they must compensate for the same, and not in Dolgoprudny.” Mr. Khlynov also complains about the shortage of sites in the region for compensatory landscaping, urging the allocation for this and prescribe such an opportunity in the bill, thus “strengthening” it.
