The story, which included a criminal complaint, a criminal investigation, an apartment and car search, and nearly 10,000 audio files, ended with an unexpected twist, Percin withdrew its proposal for criminal persecution, which fell into the water. According to the decision of the Zagreb Municipal Criminal Court, the court, in accordance with the legal provisions, had to dismiss the indictment, because for the offenses for which Odasevic was tried, unauthorized recording and eavesdropping, the persecution is not possible without the proposal of the damaged.
Although the Zagreb Prosecutor’s Office proposed a suspended sentence of nine months in prison with a two -year temptation, based on numerous evidence, including footage from a device with over 3GB of sound records, Otasevic avoided the sentence. Even the social worker, whose conversation, also secretly recorded the actor, decided to stay aside and did not file a lawsuit, despite the surprise and the non -devastating one she allegedly experienced.
Interestingly, Jelena Percin herself, after discovering a device hidden in cabinet slats, handed over all the evidence to the police, including photographs and her own testimonies. She recalled the moment she suspected her ex -husband eavesdropped on her – she noticed that she knew the details from her life she had not shared with him.
The key moment happened on March 7, 2024, when she found a suspicious device in the cabinet, which she then handed over to the police. The analysis has shown that 41 sounds on the device is an hour of an hour, and investigators have further found footage in Otasevic’s cellphone.
However, without active criminal prosecution by the damaged, the judiciary had to withdraw the indictment. Jelena Percin, even though she was a victim in this case, eventually decided not to push the matter to the end. The court ordered that it bears the costs of the proceedings, 50 euros into the state budget and cover the lawyer’s costs of his ex -husband.
The Montenegrin actor will get back his seizure of the Xiaomi mobile phone with Micro SD card only when the decision to reject the charges becomes final, since the court considered the device a means of committing a crime.
