The Federal Competition Authority has confirmed the judgment against the company. Saubermacher now has to pay a reduced fine of around seven million euros.
Around the cartel in waste management, which was flown in a few years ago, the antitrust court confirmed the fine of EUR 7.085 million against the waste disposal company. The company had contributed to the full clarification of the facts as part of a key witness program, whereupon the BWB requested the reduced, now legally penalty, the authority announced on Monday in a broadcast.
According to BWB, the Saubermacher Service Performance AG took part in price agreements, market reports and the exchange of competitive information between July 2002 and March 2021. BWB’s investigations are still underway against a large number of other companies in waste management.
The investigation into the garbage cartel was public in March 2021 when over 20 locations were observed in Austria. Energie AG in Upper Austria, Styrian Saubermacher AG and Brantner in Lower Austria confirmed house searches at the time. It was about suspicion of forbidden agreements on the damage of the industry and the waste management associations, municipalities and ultimately their citizens. The waste management market comprises around 300 companies in Austria, in addition to some national groups that act, there are many smaller companies. The supposed garbage is a billion dollar business for the companies. The industry makes sales of more than five billion euros each year. The six largest companies together come together for sales of around two billion euros.
