Around three quarters of a year after the accident of a completely overloaded smuggling car with seven deaths on the A94, the several years of prison for three accompanying drivers are final. The Federal Court of Justice rejected the revisions of the accused, like the court in Karlsruhe announced. The review of the judgment did not result in any legal errors.
In December 2024, the Traunstein district court sentenced the then 23 -year -old driver of the vehicle, who accompanied the smuggling car with the migrants, 14 years in prison; He was also the organizer of the smuggling tour. The youth chamber sentenced two passengers to five years old at the time of the judgment 24 and 18 years old.
Escape with death sequence
According to the verdict, the organizer had planned the slump from Vienna to Germany in October 2023 from 22 Turkish and Syrian citizens with small vans, which only had nine regular seats. The other two defendants should secure the smuggling against police controls with an accompanying vehicle.
However, the completely overloaded small van got into a control, raced in front of the police and crashed into the guardrail at about 150 kilometers per hour in the Waldkraiburg/Ampfing exit. A six -year -old child was thrown out of the car, stayed on the green strip and died. Another six migrants were killed. One of the injuries will remain a severe case for a lifetime, and another one will never be able to work again.
Driver also failed in front of the BGH
The Traunstein district court had sentenced the driver of the small van to death, a forbidden motor vehicle race with death and negligent killing. The Federal Court of Justice had already rejected its revision in April.
