Major General Popov was again sent under three violations
“Kommersant” became known by the grounds on which the Tambov garrison military court concluded until April 27 the ex-commander of the 58th Army Ivan Popov, accused of fraud and official forgery. The Major General, popularly prohibited meetings with bloggers and the second person involved in the case Sergei Moiseev, as well as the commission of an administrative offense, was charged. The military refused to undergo a medical examination after the traffic police stopped his car in Tambov. The general himself said that he suffered due to provocation.
The court considered the petition of the military prosecutor’s office in a mode closed to the media. The trial took several hours, and after its completion, the judge announced the decision, according to which Major General was taken into custody in the meeting room and was placed in the Tambov pre-trial detention center for two months.
According to the prosecutor’s office, Major General violated the conditions of house arrest, according to which he could be in Tambov and Moscow during the judicial investigation, but not commit offenses.
However, following in Tambov for the next meeting by car, the military was stopped by the traffic police. Assuming that the driver was intoxicated, the police invited him to proceed to a medical examination. The general refused, because he was late for the meeting (they could also punish him for this), thereby committing a violation provided for in Art. 12.26 Code of Administrative Offenses (non -fulfillment by the driver of the vehicle requirements for a medical examination for intoxication). For it, both the deprivation of rights and administrative arrest is provided. Obviously, he could interfere with the trial on the merits, which already dragged on due to the appointment of a new examination by the court.
In addition, Major General, according to the prosecutor's office, talked with military commissars and bloggers, who later acted in his support. To do this, he believes the accusation, he had to receive a special permission of the judge. Finally, the defendant « without a protocol » held a conversation with the second person involved in the case Sergei Moiseev. During the conversation, the prosecutor’s office believes, they could form a common position on the case.
General’s lawyer Sergei Buinovsky told Kommersant that the incident with the police, in his opinion, occurred due to the provocation of the latter. According to him, it is even difficult to imagine that someone went to court, having drunk before that.
With bloggers, his client, according to the lawyer, did not speak, and Mr. Moiseev simply was next to Ivan Popov, who left the court of the court to smoke. If they spread a couple of phrases, then not on business, the interlocutor of Kommersant believes.
The lawyer appeals the decision of the garrison court in the Second Western District Military Court, noting that there was no reason to change the preventive measure to his client.
Major General Popov was arrested on May 17 last year, but on July 15, the military court satisfied the petition of the Main Military Investigation Department (GVSU) of the TFR for his transfer under house arrest. The GVSU SKR accuses General Popov and entrepreneur Sergey Moiseev of a large -scale fraud (part 4 of article 159 of the Criminal Code). The general’s official forgery is also charged to the general (Article 292 of the Criminal Code). According to the investigation, before the start of the Armed Forces of Ukraine in 2023, the military requested 1.7 thousand tons of metal structures in the Military Civil Administration of the Zaporizhzhya region to create defensive structures.
At the same time, the metal was supposedly delivered with excesses, which the alleged participants in thefts sold to the side, helping more than 100 million rubles.
Mr. Moiseev, who pleaded guilty, was engaged in his implementation. And Ivan Popov, in order to take suspicions from himself, allegedly forced his subordinates to put his fake signature in the application.
According to investigators, the organizer of the crime was Lieutenant General Oleg Tsokov, who was drawn into the adventure with the metal of the commander of the 58th Army Popov. General Tsokov himself died and was posthumously awarded the title of Hero of Russia.
