Made to pay 2.7 million for car purchases
The District Court of Reykjanes has sentenced Go Trans ehf. to repay the purchase price of Toyota Land Cruisers following the cancellation of a purchase agreement between the company and the buyer. In addition, the company was made to pay the man just over ISK 1 million in legal costs.
The verdict was issued on Friday.
Considered belief about the « top stand » of the car
On October 19, the man purchased the car, which is of the Toyota Land Cruiser 120, model 2004, by Go Trans ehf. An advertisement on the car stated that it was in the « top condition » and that the « sills and frame had been done. It was also specifically stated that the car was all re -enacted.
The estimated price was ISK 1,990,000, but the buyer agreed to pay ISK 1,625,000. for the car and he describes in court that the condition of the car, which he had been believed to be in top condition, was the reason why he decided to buy the car.
The man says that in July 2024 he took the car to an inspection station for general inspection. It has also been found that the description of Go Trans ehf. The car had no argument to support, but it did not stand up to the defects of it.
Legal costs amounted to over a million
In August 2024, the man sought the assistance of a lawyer to cancel the contract, but he had not received any answers from the company to his complaints. The case was brought in November and the main proceedings took place in February and March.
The representative of Go Trans ehf. requested the case in the case, but he based the claim firstly on the fact that the car had not been held shortly when the transaction took place. Secondly, he was based on the fact that if there had been a fault on the car then the man’s claim would have been dropped for emptiness and thirdly that there was no basis for cancellation where there were no conditions for cancellation.
The district court, on the other hand, confirmed the cancellation of the man’s purchase agreement and Go translate ehf. last week and the company was made to repay the purchase price of the car, up to ISK 1,625,000, as well as legal costs of ISK 1,090,180.
