Lydie Polfer: « We didn’t have anything to hide three years ago – nor today »

« The Center for Urban Justice (train) was clearly right – according to the Transparency Act, access must be granted, » emphasizes François Benoy (Déi Gréng). For him, the judgment in the second instance about the long -term discussion about the security of zebra strips is a clear success of civil society, especially with regard to transparency. Already at the beginning of the month, the opposition had made an urgent request that came up in the local council on Monday afternoon.

« It was a fight between David and Goliath – and David won, » says François Benoy in retrospect for the entire dispute. In the second instance, Zug was also right at the beginning of June of this year. This gives you an insight into the analysis of the city for pedestrian crossings and the associated internal memo. Zug can now view the data on site and in the presence of a member of the administration for eight hours. Because the database is about « fundamental security », says Lydie Polfer (DP). For François Benoy, the judgment is also a clear testimony: a bad grade for transparency. As a community, you should act transparently in your eyes.

How expensive was the « stubbornness »?

Among other things, the local council wanted to know on Monday how much the « stubborn attitude » of the lay judge ultimately cost the taxpayer. According to Lydie Polfer, the city of Luxembourg paid « Kee Frang » – such expenses are covered by an « Assurance Juridique ».

And how access to the database will be regulated in the future. Mayor Lydie Polfer reacted promptly and decidedly: « Your presentation does not really correspond to reality. We are happy to stay with the facts. » It was a question of the principles, said the mayor. And this also applies to train. The focus of the debate is whether the controversial document is an internal document.

The history

475 dangerous zebra crossing found Zug in an analysis almost four years ago, of a total of 1,787 in the area of the city of Luxembourg. In its own investigation, the municipality had counted 37, which were not legally compliant with the Code de la Route. Zug then wanted to see the analysis of the city of Luxembourg. However, this was repeatedly denied. In 2022, the commission d’Ccès aux documents (CAD) was commissioned and announced that the documents of the city of Luxembourg could be communicated. But the documents still didn’t get the documents. So they decided to go the way to the administrative court.

« Schöffen council meetings are not public – and accordingly it is not the documents presented there, » explains Mayor Lydie Polfer. However, the document in question later found its way into a meeting of the local council – and was therefore no longer considered an internal document. One day after the judicial decision, the three -sided document was forwarded through the lawyer to Zug.

On April 22, 2022, Zug was offered an appointment with the corresponding department for the inspection of the affected zebra crossings. « Dat ace down. Zug then called for access to the corresponding extracts from the database-specifically in the form of a USB stick. And that was now denied to them.

The municipality offered Zug again insight into the documents in question, but has so far not received any feedback. Thorben Grosser von Zug explains in the LW conversation: « We were not on trial for four years to miss it now. » However, they wanted to prepare for the appointment and also wanted to wait for the municipal council meeting. « We will sit down with the city of Luxembourg in the coming weeks. »
