Damir Misir, who was tried in resentment, was sentenced to four years in prison at the Zagreb County Court for smuggling migrants as part of a criminal organization, while the second defendant Neven Miljkovic was sentenced to a partial suspended sentence of one year and two months. He has to endure six months in prison, and he will spend the rest of the eight months at large if a new criminal offense of a four -year trial of four years.

Misir must pay into the budget and unlawful property gain in the amount of EUR 22,000, 15 days of the judgment’s finality, and both have to pay 2000 euros in court costs. Misir must still settle the costs of a court interpreter in the amount of EUR 1116, and will have to settle the costs of the veterans ex officio ordered to him by the court.

Investigators have secretly recorded and monitored members of the group, and the transcripts of conversations and reports on their movement are also part of the evidentiary material.

They also obtained evidence of payments, to which unknown people from Turkey paid illegal crossing and transportation.

Although the Misir was not charged as an organizer, and thus, he could not even be convicted as an organizer, his role was organized, according to the Council, crucial.

The trustee was also testified about how the first defendant coordinated the actions, who described that the Misir, with one of the three defendants, would be a predecessor of the vehicle in which migrants were transported. Their role was to report and warn if they sprayed the police patrol.

In his defense, Miljkovic confirmed that he was in communication with other members of the group, but denied guilt for the act alone.
– The Council undoubtedly established the accused on the basis of all the evidence of the proofs, the accused committed criminal offenses as charged with them. In connection with the height of the sentence, the Council has made it difficult to appreciate the fact that the first defendant was repeatedly convicted, among other things, for the same criminal offenses. It is, in fact, a special returnee – said the President of the Trial Chamber.

Specifically, the Misir was expressed for the same work for the same work for the common good, and in July 2019 he was sentenced to two years in prison. He was also convicted of property criminal offenses, that is, fraud, theft and computer fraud.

Miljkovic, however, was convicted of the illicit holding of weapons for a suspended sentence. He also includes about the year he spent about a year in prison.

The party’s verdict is entitled to appeal.
