In the case of the founder of Rusagro Vadim Moshkovich, new victims appear
As it became known to Kommersant, the investigation increased to 48 billion rubles. The amount of damage in the case of the founder of Rusagro Vadim Moshkovich, accused of fraud and abuse of powers. At the same time, the investigation was recognized not only by the ex-owner of the Solar Products holding Vladislav Burov, but also by the Federal Tax Service and the Singent Crediter, which has already filed a lawsuit for almost 1 billion rubles.
“Kommersant” became known the details of the plot of the charges against the founder of Rusagro Vadim Moshkovich and another person involved in the criminal case – the former general director of the company Maxim Basov. At the moment, in the investigation, which is conducted by the Investigative Department of the Ministry of Internal Affairs, two episodes (Article 201 and Article 159 of the Criminal Code of the Russian Federation; abuse of powers and especially large fraud). The main concerns the acquisition of the solar products holding under investigation from its founder Vladislav Burov. According to the investigation, in the period from March 2018 to February 2019, the defendants and their unidentified accomplices “by deception” acquired 1020 shares (85%) of the Cyprus company Quartlink Holding Ltd. (Quartlink) belonging to another company registered in the same country – Solpro Investment Ltd. (« Solpro »), the owner of which was Mr. Burov. According to the investigation, gentlemen Moshkovich and Basov did not fulfill the obligations to repay the loans of “sun products” when concluding a transaction.
Earlier it was reported that the case refers to damage exceeding 30 billion rubles, but now, according to Kommersant, the investigation materials say about the amount of “at least 47 billion rubles”.
The second episode is about abuse of authority (Article 201 of the Criminal Code of the Russian Federation), which, according to the investigation, the defendants committed in 2018–2021.
Having received at their disposal 85% of the Quartelinka and, accordingly, the full control of the companies included in Solpr, the accused, according to the investigation, concluded a series of economically unreasonable and unprofitable transactions on their behalf, which caused damage in the amount of “over 1 billion rubles”. It should be noted that now in the bankruptcy stage there are three firms Solpr – Solar Products, Volzhsky Terminal and the Atkarsky Oil Excitation Plant. Losses from this crime, according to the Ministry of Internal Affairs, were incurred by independent creditors of companies included in the holding, as well as the UFNS of the Saratov region who has not received taxes. So far, among the victims, one creditor is featured – Singent LLC, but their number, and therefore, the amount of damage in the future may increase.
Thus, for both episodes, the amount of sane damage is about 48 billion rubles.
Meanwhile, in the Moscow City Court on April 23, the appeal of the defense of the arrest of Vadim Moshkovich was considered. Lawyers pointed out the unreasonableness of the decision of the philistine court, who sent a businessman in a pre -trial detention center until May 25. In particular, they were noted, the positions that the defendants held at Rusagro are indicated in the resolution of the Plenum of the Supreme Court (Sun), who are prohibited from being detained by the accused of crimes in the field of entrepreneurial activity. Moreover, the Armed Forces more than once noted that only the severity of the charged, and the philistine court, according to the defense, ignored this requirement, could not serve as the basis for arrest. In addition, lawyers said, the investigation is now actually conducting only an audit on the request of the victim Burov and does not have evidence of the guilt of the defendants. Moreover, in 2023, the police already refused to initiate the case for the same circumstances.
The defense proposed to cancel the decision of the court of first instance and appoint Vadim Moshkovich a bail in the amount of 1 billion rubles, which is ready to introduce Rusagro (a certificate from Alfa Bank was presented on the availability of such an amount in the company’s account), house arrest or a ban on certain actions.
The prosecutor was also opposed by the lawyer Maria Kileso, a representative of Singent (Russian daughter Syngenta, owner – Chinese State Corporation Chemchina). The latter, in particular, noted that the accused did not extinguish the damage to the victim and was not taking any steps for this, in connection with which a lawsuit was filed against him in the amount of almost 1 billion rubles. And the investigator, in turn, told the court that now the defendant was checked for involvement in new criminal episodes, and proposed to introduce the appropriate materials to the case. The lawyers protested, and the court took their side in this matter. However, the main defense was refused: Vadim Moshkovich was under arrest.
