In the Accounts Chamber, Russian GAS « Justice » was criticized
The judiciary of the Russian Federation turned out to be “outside the region of digital transformation of public administration”, follows from the report of the Accounts Chamber (SP). The unified information space of the courts is not formed, there is no current development strategy, and the main information system of GAS “Justice” is hopelessly outdated and, it seems, is no longer subject to modernization. As a possible alternative to the joint venture, the information system of courts of general jurisdiction of Moscow is called.
As noted in reportprepared by the auditor of the joint venture Svetlana Orlova, the digitalization of work processes could help the courts cope with the growing number of cases, but progress is inhibited by the insufficient organizational readiness of the system for changes and the lack of strategic planning documents. Another problem of ships is the lack of a single information space. The constitutional and supreme courts (Sun) have their own information systems. The judicial department under the aircraft, which ensures the work of the territorially distributed automated system of GAS “Justice” is responsible for informatizing the courts of general jurisdiction. Most of the courts of general jurisdiction are connected to it (143 thousand automated jobs placed on 2394 facilities), but not all. So, the Moscow City Court, 35 district courts and 471 world sections of the capital are connected to the comprehensive information system (KIS) of the vessels of the general jurisdiction of Moscow. And the arbitration courts have two information systems from the time of the Supreme Arbitration Court at once: “legal proceedings” and “forensic arbitration paperwork”, while the database is responsible for the “Electronic Justice” software, owned by JSC Prav.ru. Finally, world courts in many regions have their own information systems created at the expense of the constituent entities of the Russian Federation.
According to the joint venture, although the judicial department, in the framework of the State Program “Information Society” and participated in the implementation of the Super Service “Justice Online”, the submission of documents in electronic forms was implemented in only 75 regions (in 88% of the total number of federal courts and 46% of the sections of the peace). At the same time, the report is noted, GAS “Justice” is morally obsolete and “regresses” sequentially. Its architecture is based on technically outdated foreign software products and has limited integration capabilities, and work on external site safety verification was last carried out in 2015. The hacker attack on October 7, 2024 led to a loss of control over the GAS “Justice” and the probable loss of a consolidated database, where more than 89 million decisions were stored (33.6% of the total number of judicial acts in a single file of court cases).
In this regard, it is necessary to analyze GAS « Justice » for its further operation, they believe in the joint venture.
The report gives the calculations according to which the replication of the Moscow system for all courts of general jurisdiction will cost just more than 2.2 billion rubles. – this is half the annual expenses for the operation and development of GAS “Justice” (see schedule). The metropolitan system is noted in the joint venture, differs from GAS “Justice” by a wider set of functionality, has a more friendly and modern interface, and is also integrated with the FSSP services and allows you to get acquainted with the criminal case from the pre -trial detention center. In addition, in Moscow they store audio -Video -records of the trials of court hearings at the data center (data center), while the judicial department spends more than 100 million rubles annually. on the purchase of CDs for recording audio protocols.
In the future, the report is noted, it is possible to transfer to the newly created information platform and arbitration vessels. In this regard, the joint venture believes that the Armed Forces, together with the Council of Judges and the Judicial Department, must decide on the main areas of development and application of information technology.
The press service of the Armed Forces at Kommersant’s request about the prospects for the modernization of GAS “Justice” replied that this issue does not belong to its competence, and the organizational support of the courts is carried out by the judicial department. The department “Kommersant” promised to prepare an answer in the coming days.
A source close to the FBBU « Information and Analytical Support Center » Justice « (created under the judicial department) says that the prototype of the new judicial information system may appear before the end of the year: the search for options is underway, but there is no certainty yet.
According to him, the main problem is the creation of a data center for a system of such a scale. For the same reason, the interlocutor “Kommersant”, the assessment of the replication of the metropolitan KIS to the rest of the regions, is sure of the Kommersant’s report: taking into account the value of the data center, this is a completely different budget.
A researcher at the Institute of Law Problems Sergei Bondarkov believes that the Moscow Arbitration Court will be a landfill for innovations in this area. As the expert recalls, the SP report says that the Ministry of Construction, the Federal Treasury and the Judicial Department agreed on the pilot site for the development of general approaches “in the field of introducing modern information and communication technologies in the process of legal proceedings and judicial paperwork”. “If you are interested in the organizational side of the work of the courts, it makes sense to follow what will happen in the Moscow arbitration,” summarizes Mr. Bondarkov.
