How will you remove your property from forest maps

Thousands of property owners in off -plan areas find – suddenly – that their property appears on the forest map as a forest and is claimed by the State (!).

The… revelation is usually made during the process of posting the rights on the Land Registry, but also during the drafting of the contract, where they find that the ratified forest map in their area shows their assets as forests.

For this reason, « TA NEWS », with the help of the topographer-bacter Baklatsis, presents through 10 questions-answers all the information that these owners must keep in mind in order to save their property.

Interested parties should bear in mind that the procedure to follow is not that of objection, but of the map correction application. Applications should be submitted electronically to the local Forest Directorates so that the forest maps can be corrected.

At the same time, tens of thousands of property owners are trapped – mainly – because of the bureaucracy and cannot use their properties…

These are owners who have been justified by the Forest Addresses, because of the aforementioned bureaucracy and the under -staffing of the services, the forest map has not changed so that the sale and sale of their property can not proceed, as they appear on the map as a forestry.

What is the correction concerned

It is clarified that the aforementioned correction does not concern cases where the areas are clearly shown that the areas are forest or overwhelmed or forestry. It only concerns the cases of error, inaccuracy and ambiguity of the forest map.

For history, the 460,000 objections to forest maps and the requests of manifest error submitted to the relevant committees have reached 460,000. Of all these (objections and obvious errors), according to sources from the Ministry of the Environment, 35% (161,000) has been examined. The areas with the biggest problems are East Attica and Crete, followed by Central Greece and Laconia.

What are the errors that are corrected?

The following errors are corrected:

n Those that due to cartographic backgrounds.

Here, the accuracy of the map, created by the composition of two different aerial photographs of 1945 and 2007, is generally controlled, as major changes were made during this time.

n The errors due to the wrong placement of the thematic boundaries.

That is, the line that separates a forest area from a estate was not properly crossed. This is mainly the case at the edges of the forest -bordering fields, where, for example, leafing is within a private agricultural area.

n Errors due to omission or mistake of displaying thematic areas (relating to form or character).

An example: to appear as a forest area a horticulture or an old olive grove, which due to the severe slope of the soil during the photo interpretation of the aerial photographs was interpreted as a forest.

n Errors due to omission or incorrect registration of data (matching).

For example, he does not write within the polygon what the character is of (DD, AD, DA, if IX, etc.).

n Errors due to modified elements following a picture processing due to classified areas.

It is noted that classified areas are areas that are processed on the map for national security reasons and this may have affected the surrounding area as well.

n Errors resulting due to the inclusion of lowland grassland, rocky or stone areas.

The « lowlands » are considered to be less than 100 meters in height with an average inclination of less than 8% and a maximum slope of less than 12%, which carry grassland or are rocky and should be seen as « other form/coverage » (AA).

n Errors due to the inclusion of grassy, rocky or stone areas recognized as private.

This category includes the heirs given with concessions to individuals.

n Errors due to the inclusion of artificial forest plantations as forest areas.

These are plantations (eg Lefkons, Christmas trees, forest plantations), created on private agricultural land for the purpose of logging, trafficking and trading forest products.

n Specific errors due to omission of administration acts before ratification of the forest map.

This category covers cases such as: not to be properly passed the act of designating the Forestry, or the city plan limit, the boundaries of reforestation, etc.

Who is considering the map correction application?

Applications for correction of an error of error are examined by the Forest Directorate and do not go to the objections committees. If there is agreement and acceptance for the manifestation of the error, the relevant correction is made.

When does it change the forest map?

The ratified forest maps are rebuilt by the addition or deletion of the areas that will be subject to or cease to be subject to the forest law, which had to be included in the forest map and not depicted on it or incorrectly imprinted during ratification.

How to ratify the reform of the forest map?

The reform of the forest map is ratified by decision of the Secretary General of Forests, issued hierarchically following a recommendation by the relevant Forestry Directorate and its approval by the Directorate -General for Forests and Forestry of the Ministry of the Environment and Energy.

What about the ownership of the areas after the reform?

For the areas of the Forest Charter, which are added as A/A and were not subject to the forest law at the time of ratification, no rights are claimed by the Greek State in accordance with the provisions of forest law.

Where does the State do not claim rights?

The State does not claim and claim ownership rights in land, which, according to the forest map, are governed by the provisions of forest law and relate to polygons or strips, created by the application of the land charts on the forest maps, which are not exceeded by 100 measures, the technical specifications of the National Land Registry training.

Is there a specific room for the reform of the forest map?

The legislation does not provide for a specific time to make the correction. Theoretically, each time a correction request is being examined and correction, the relevant Forestry Department must send a recommendation to the Directorate -General for Forests and Forests of the Ministry of Environment and Energy, which should also approve it and then be ratified by the Secretary General. But it is practically difficult to constantly make decisions to reform the map.

Who concerns The correction application?

It is exclusively concerned with land owners outside the city planning areas where the forest map was partially ratified.

Where can a owner be informed about the moves it should make?

The ratified forest map is available on the website www.ktimatologio.gr and in forest shoots. Also, if the person concerned does not know the exact location of his field, he may go to a topographic engineer to detect his property, and advise him if the property actually appears as a forestry map and what needs to be corrected.

What supporting documents should be deposited to correct the map due to an error manifest?

The person concerned must testify:

n Related to the Forest Address

n contract of ownership of

n the E9

n photocopy of identity

n Coordinates of the area in Eye 87

n Documents of the administration (eg concession, act of designation, a Certificate of Engineer for 1955, etc.).
