How will the aspirants in Cotroceni change the Constitution
The candidate of the electoral alliance « Romania, before! » At the presidential elections, Crin Antonescu, said on Wednesday that at the moment when the fundamental law would be discussed, there would be more logical and faster procedures to unlock a crisis by dissolving the Parliament.
The candidates were asked, at the debate organized by Antena 3 CNN at the Parliament Palace, what articles of the Constitution would propose to be modified, as head of the state, to a possible revision of the Fundamental Law.
« I do not have the modification, the initiation of a process of modifying the Constitution, but of course it can occur. All articles that clarify all the ambiguities in what the executive of the president and the executive power of the prime minister, ie the duties of foreign policy, tacitly and by decisions of the Court, we now now have the president, but I have an article in the Constitution that says that the Government does the internal and external policy of Romania, This Constitution will be modified, to have more logical and faster procedures for unlocking a crisis by dissolving the Parliament ”, said Crin Antonescu, at the debate organized by Antena 3 at the Parliament Palace.
Nicușor Dan said that the modification of the Constitution is not a priority for him, if he wins the presidential elections.
‘I believe that, through the many developments that the Constitutional Court has made, we have a constitutional framework that is well understood by the administrative system. In my political program I did not say the modification of the Constitution, I said the modification of the law of operation of the Constitutional Court, which can be done without amending the Constitution, only by vote in Parliament, for the CCR judges to be professional magistrates. I think it is important that if a judge judges you for a bicycle, for an important matter of the state to judge you a judge. In perspective, I think that an important change in the Constitution would be for the proposals of CCR members to come from the judicial system, but before that we must make a good representative of the judicial system, because at the moment it does not exist, « said the general mayor.
He reminded that there are two decisions of the Constitutional Court, according to which the referendums are mandatory. On the other hand, said Nicușor Dan, the vote of Bucharest expressed at the local referendum of 2024 was ‘violated’ by the law of the national budget.
« The problem is how long you have access to the Constitutional Court, because, unfortunately, at the moment, you have access about three years, from the moment you make the notification, » said Nicușor Dan.
Lavinia Șandru, the candidate put in the presidential elections, said on Wednesday night, that he would propose that Romania be a presidential republic by American model, arguing that otherwise things would go to the country when the president would be prime minister.

« I would come up with a proposal, after a prior national debate, to modify the Constitution in such a way that Romania is a presidential republic according to the American model (…). When the president would be prime minister, otherwise things would go to Romania. She also said that she will be a president involved, and the Constitution gives her the right to be the voice of the Romanians.
« I have read it several times. I was very concerned about article 86, 87 and 88, to see how I could influence the government or Parliament, how I could be the voice of the Romanians, that I am interested in involving myself. I will be an involved president, but it gives me these rights and I can fight for Romania.
The independent candidate for President John-Ion Banu-Muscel said on Wednesday that the popular referendum must have « executive power ».
The seven candidates for the position of President of Romania, present at the debate organized by Antena 3 CNN at the Parliament Palace, were asked what would change in the Romanian Constitution.
« The Constitution must serve the interests of the nation, of the citizens. Therefore, the first thing I would modify in the Constitution is to give a voice to the people, to make the popular referendum have executive power, » said Banu-Muscel.
He pleaded for a minority executive.
« I would make our government a minority government, by no means a majority government, a government that, by 33%, through the direct vote of citizens, should be sufficient and in this way to give voice to our Parliament, » explained the independent candidate.
The candidate of the Romanian National Conservative Party in the presidential elections, the MEP Cristian Terheș, wants to modify the Constitution by defining the marriage as the free-consisted union between a man and a woman and the inclusion in the fundamental law of Romanians to have cash.
‘I had the chance in 2018, at the then referendum, to have this provision introduced in the Constitution. Unfortunately, as a result of an odious manipulation that took place in Romania, not many Romanians went to vote, so that referendum had no quorum. Today, however, it is seen why the provision was important, because it is no longer talking about the husband, but about man and woman. It’s unclear today what a man is, what is a woman. But today we are in a situation, at the level of the European Union, where a woman is unclear. And it is important to specify that when we talk about man and woman we talk about sex, which is clearly established at birth, « Terheș said on Wednesday, at the debate organized by Antena 3 CNN, at the Parliament Palace.
Another modification of the fundamental law that Cristian Terheș would like is to introduce the clarification according to which ‘in Romania, the Constitution is the supreme law in the state’.
‘We have the Constitutional Court which is the guarantor of the supremacy of the Constitution, but we do not know which and where, how, what the supremacy of the Constitution means. At European level, today, there is talk of federalization, and the direction to which we are heading is to lose our sovereignty, « added Terheș.
According to the MEP, a new provision in the Constitution should be the one regarding ‘cash’.
