How did we lose a process and 54,000 lei?

The past days, after another trial, which have changed several judges and complete and which lasted almost 4 years, I received a definitive court decision, pronounced in the file no. 31311/299/2021. Based on its decision, Casa Serafim SRL, the daily publisher, paid the amount of 54,600 lei in a bank account to Brândușa Armanca as moral damages and costs.

I reproduce the description of the situation by a formulation from the decision device and then the measures established by the court.

First, what was it about?

« In fact, he revealed that, on 03.08.2018, on the website www.cotidianul.ro belonging to the appellant Casa Serafim SRL was published the press article » Fight for Timisoara Cultural Capital « (f. 22-26, vol I File), which treated the subject of an outbreak of a scandal at the local level after the Municipality was proposed to the Capital. European cultural in 2021. The article started from the accusation formulated by the local civic movement « The Timisoara Reflection and Initiative Group, European Cultural Capital »-of which the respondent Armanca is a part, according to which behind the project could have been hidden a massive waste of money « (Pag 23-24) no.

On page 44, in the text of the civil decision no. 821A specified:

« Contrary to those revealed by the appellant-applicant, the court cannot retain the existence of a negative press campaign carried out by the appellants against it, provided that the appellant-applicant did not prove that they were the ones who have published the press materials with similar content for the purpose of discredit and did not apply to the article Therefore, without underestimated the illicit of the deed and the damage caused, which certainly should not be made, the court finds that it is not necessary to grant a superior compensation regarding the appellant-applicant. the appellants-defendant ”.

In the device of the definitive decision, the Bucharest Court – Section A will civil, by the civil decision no. 821A, pronounced by the public meeting on March 31, 2025, has:

« Admits the appeal formulated by the appellants-applicants Armanca Brânduşa and Armanca Alexandru Gheorghe, both with the procedural domicile chosen at the Cab. Ionic Ioana-Alina in Bucharest, (….) Against the civil sentence no.

Admits the appeal made by the appellants-parâți Nistorescu Cornel and Casa Serafim SRL, both with the procedural domicile chosen at the CAB Paul-Georgeta Căta (….) Against the civil sentence no. 3995 from 06.05.2022 pronounced by the District Court 1 Bucharest, having as object « pretensions 100,000 + 100,000 lei moral damage ».

Changes, in part, the sentence appealed in the sense that:

-Obligi the appellants-defendants, in solidarity, to pay to the appellant-applicant Armanca Brânduşa of the amount of 30,000 lei as moral damages.

-the appellants-defendants, in solidarity, the payment to the appellant-applicant ARMANCA ALEXANDRU-GHEORGHE of the amount of 10,000 lei as moral damages.

-Obligă the appellants-defendants at the removal of the article « Fight for Timisoara Cultural Capital » published on 03.08.2018, on the website www.cotidianul.ro.

-Bligă the appellants-defendants, in solidarity, to the payment to the appellants-applicants of the amount of 6,727.93 lei as court costs consisting of a judicial stamp duty, a lawyer’s fee, value of provision, printing the documents annexed to the request for a trial and taxes « .

In the articles in everyday life we ​​tried to present the state of conflict and the struggle carried out by an initiative group for taking over the management of the association that won the project « Timișoara European Cultural Capital ». After countless accusations and disputes, the management of the association resigned, the group took control, the program carried out in the world’s view, we were wrong publishing an article in the virtual space (later withdrawn!) And we were sanctioned, as the civil decision no. 821a/March 31, 2025 (despite the fact that we presented countless evidence regarding a local conflict and the struggle for taking control over the project « Timișoara Cultural Capital of Europe »).

The article « Fight for Timisoara Cultural Capital » was deleted, which does not mean that it existed.
