Hajrullahi files criminal charges against state prosecutor Kocevski
Higher Public Prosecutor Mustafa Hajrullahi today filed criminal charges against Ljupco Kocevski – Public Prosecutor of Macedonia, Tatjana Kacarova – Public Prosecutor in the BPPO Stip, Risto Bojadziski – Senior VCO Stip and Ermon Neziri 353 of the Criminal Code.
Hajrullahi has been suspended from the management position of the Higher Prosecutor's Office Skopje, following a curved report for a reasonable suspicion of committing a prolonged crime of « harassment in the service referred to in Article 143 », as well as an extended crime of « abuse of official position and authority under Article 35 The decision to move away from office, made by State Prosecutor Kocevski.
Hajrullahi said in a statement to MIA that he believes the criminal charges have been biased against him by the State Prosecutor, as since February 2023 has amended the suspended prison sentence for the crime charged in Article 353 of the Criminal Code. As he said until February 2023, this offense was provided for a stopped caza of five years and then eight years in prison. He believes that the state prosecutor should have taken into account the lesser sentence when he filed criminal charges, and if he did so he had no right to open an investigation into the crime he charged.
About four months ago the St Earlier, criminal charges for harassment in the service were filed with the Public Prosecutor's Office of Macedonia by a group of employees of the Higher Public Prosecutor's Office Skopje, after which it was followed by the competent conduct of the Stip Basic Public Prosecutor's Office. During the investigative actions undertaken by the Stip Prosecutor's Office, data and information are obtained that also point to the actions of abuse of power and authority. Following the receipt of the report for an investigation, under Article 81 of the Law on Public Prosecutor's Office, the State Prosecutor decided to move away from the post of Hajrullahi during the criminal proceedings initiated after the report filed against him.
