GP intends to confiscate the largest PVC production in the family of ex-deputy

As it became known to Kommersant, the Prosecutor General’s Office of the Russian Federation intends to turn the assets of the largest producer of polyvinyl chloride (PVC) of Sayanskhimplast JSC worth almost 79 billion rubles to the state’s income. The anti -corruption lawsuit was filed in the Khamovnican Court of Moscow to the actual owner of the enterprise to the former head of the Legislative Assembly of the Irkutsk Region, Viktor Kruglov, as well as his wife and children. At the request of the plaintiff, the court has already imposed security arrest on all their property.

According to Kommersant, by the defendants in the lawsuit of the Prosecutor General’s Office, in addition to Viktor Kruglova, his wife Irina Kruglova, as well as the children of Anna and Alexander are the former first deputy head of the Irkutsk Region and ex-gender of the enterprise Nikolai Melnik.

The lawsuit states that, contrary to the prohibitions and restrictions established by laws, Viktor Kruglov combined business and civil service.

So, from 2000 to 2016, he was a deputy from United Russia in the Legislative Assembly of the Irkutsk Region, was a member of the Committee on Property and Economic Policy, and in 2004-2008 he headed the regional parliament.

The supervision also established that since 1968, the Ziminsky Chemical Plant, which was transformed in the Sayanskhimprom OJSC, operated in the Irkutsk region since 1968. This plant was a city -forming enterprise of Sayansk and the largest producer of polyvinyl chloride in the country, which is used in various industries. The lawsuit states that Mr. Kruglov since 1987 held leading positions at this plant, and after his appointment by the CEO in 1997, he decided to “turn the state -owned enterprise in his favor”. To do this, in 1997–2000, he established subsidiaries, in the authorized capital of which the production capacities of Sayanskimprom OJSC were withdrawn. Then the general director seized the “daughters” from the management of the enterprise itself, having issued them to the firms specially created by him. At the same time, Viktor Kruglov himself actually acted as a seller and buyer of shares and shares of legal entities, the lawsuit noted.

After Mr. Kruglov took possession of part of the property complex of the state -owned enterprise, he, according to the supervision, organized the conduct of a business under the Losses Center – OJSC Sayanskkhimprom, the Profit Center – JSC Sayanskhimplast. “All revenue from the sale of products was accumulated in the accounts of the Sayanskkhimplast specially created by Kruglov, and debt obligations were assigned to the state -owned enterprise,” the statement of claim (is available to Kommersant). As a result, in 2003, Sayanskhimprom OJSC was brought to bankruptcy, its fixed assets bought a structure controlled by Victor Kruglov and the entire production fund was accumulated in Sayanskkhimplast JSC. “This allowed Kruglov V.K. to hide the belonging of production capacities to the state and create the appearance of the functioning of private business,” supervision points out. In the lawsuit of the Prosecutor General’s Office, it is noted that annually JSC “Sayanskhimplast” produces 250 thousand tons of raw materials, this leaves 30% of the total production in Russia.

The assets of the enterprise are estimated at 78.8 billion rubles, annual revenue – 25 billion rubles, gross profit – 7.2 billion rubles, the staff of employees is 6.5 thousand people.

The prosecutor’s office draws attention to the fact that, owning and managing the enterprise, Mr. Kruglov used the status of a folk chosen one “for personal enrichment”, creating illegal “preferences and uncomfortable advantages to his own business.” The fact is said in the claim that the defendant himself was part of the relevant committees and commissions of the Legislative Assembly of the Irkutsk Region and had access to official information about the most important industrial and infrastructure facilities in the field of chemical production, end beneficiaries and priorities of state development for their development. Access to this information gave him the opportunity to select counterparties and conclude the most profitable agreements in the interests of his own business, the application was indicated. In addition, he believes supervision, Viktor Kruglov ensured the adoption of a number of legislative decisions, which, in particular, allowed Sayanskhimplast JSC to receive tax benefits.

The prosecutor’s office notes: neglecting the anti -corruption prohibition of entrepreneurial activity, Mr. Kruglov not only did not declare the unlawfully received income from the economic activity of the plant, but also withdrew money to the accounts of offshore enterprises, including Cyprus. At the same time, he, being a deputy, received the citizenship of this country in 2014 without notifying the Ministry of Internal Affairs of this, but did this after the addition of his authority in March 2016.

In order to “legalize corruption -acquired income and create the appearance of the legality of the origin of numerous property,” the lawsuit said, in May 2016, Viktor Kruglov eliminated the nominal Cyprus offshore Yanden Enterprises Limited and transferred 100% of the shares of Sayanskkhimplast JSC. After that, he gradually re -registered securities on his relatives living in Cyprus and also having the citizenship of this country – his son, daughter and wife. Viktor Kruglov also made illegally acquired property as contributions to the authorized capital of LLC Businessintellect, LLC Sayanskgazobaton, LLC Businessactiv and LLC Vector. The prosecutor’s office asks to withdraw shares and shares of these enterprises from the defendants and turn them into state revenue.

It is worth noting that initially the anti -corruption lawsuit was to be considered in the Irkutsk region – at the location of most defendants. However, taking into account the vast and various connections of Mr. Kruglov in this region, the prosecutor’s office has achieved a change in the jurisdiction of the case to the Khamovnican Court of Moscow – at the place of registration of his son.
