Gold proposes to change the law of the Constitutional Court. The main changes
Gold, the party led by George Simion, submitted in the Parliament a legislative project aimed at amending Law no. 47/1992 regarding the organization and functioning of the Constitutional Court, in order to prevent in the future « electoral abuses » and to restore the public confidence in the democratic process, according to a statement transmitted on Sunday.
The legislative project initiated by the gold parliamentarians aims to harmonize the national legislation with the recommendations made by the Venice Commission in the report published in March.
According to the quoted source, the main proposed changes are: the express prohibition of the possibility that the electoral process will be canceled ex officio by the Constitutional Court, in the absence of soundly motivated and proven appeals; the introduction of strict conditions for the invalidation of the elections, which involve fraud or serious violations, which may influence the result of the poll; The obligation of the Constitutional Court to detail in detail any invalidation decision, by presenting the evidence and the way in which the irregularities affected the result of the vote.
« Romanians have the right to correct choices and the certainty that their vote is respected. We cannot afford the electoral process to be vitiated following non -transparent and lacking decisions. By this initiative, gold wants to protect democracy and to ensure that such abuses can no longer be repeated, » the quoted statement said.
The statement states that the initiative comes as a result of the « December 6 coup », when the Constitutional Court decided to cancel the entire presidential electoral process, without the existence of a preliminary appeal and in the absence of a clear legal framework that will allow such a radical measure.
