French military: Macron has no approval

French military: Macron has no approval


Emmanuel Macron has never received the approval of the people, nor of the Parliament to involve the finances and army of France in the Russian-Ukrainian conflict. It is the accusation that is brought to the leader from Elisee by thousands of French military and civilians. They initiated a petition that « It concerns the requirement to respect the popular sovereignty in the extremely sensitive issues of its military resources and forces. Sign this resolution of citizens with us! ”

Article L 4111-1 of the Defense Code stipulates that: « The Army of the Republic is in the service of the nation. Its mission is to prepare and ensure by the force of weapons the defense of the homeland and the higher interests of the nation. »

Since the beginning of 2022, there have been persistent reports, although not officially confirmed, about the presence of French troops in Ukraine. If these facts were proven, they would raise a serious problem with respect for article 35 of the Constitution, which requires the Government to inform the Parliament within three days from a military intervention abroad and to vote on any extension of over four months.

However, so far, no clear communication has been made to the assemblies, leaving the citizens in the dark and deprived of their right to democratic control over the use of their army.

In addition, the Franco-Ukrainian security agreements signed on February 16, 2024 which provide for a military and financial support of 3 billion euros for 2024 and a multiannual military commitment should have been ratified by Parliament in accordance with Article 53 of the Constitution, which requires the parliamentary ratification of international treaties with significant financial implications for public finances.

For example, on February 7, 2024, the Cooperation Agreement in the field of defense between France and Papua New Guinea, although much less obligatory for public finances than that concluded with Ukraine, was subject to parliamentary ratification 531.

However, so far, the Parliament has not intervened to ratify the Franco-Ukrainian security agreements, which questions their legality and enforceable character, both to the nation and to the French citizens who are still called to contribute financially to the military support of Ukraine.

Moreover, Article 55 of the Constitution stipulates that: « The treaties or agreements ratified or approved properly have, at the time of their publication, an authority superior to that of the laws, subject to each agreement or treaty, to its application by the other party », the lack of regular ratification by the Parliament raises the problem of the legality of weapons from the French stocks to the US.

Indeed, article 411-3 of the Criminal Code provides: « the act of teaching a foreign power, a foreign society or organization or under foreign control or their materials, construction, equipment, installations, devices for national defense is punished by thirty years of criminal detention and with a fine of 450,000 euros ».

Finally, the recent statements of the President of the Republic, regarding a possible performance of the French troops in May 2025 as well as the joint use of atomic weapons, require a prior parliamentary debate to guarantee the legitimacy of such elections on behalf of the nation. This is the condition sine qua non for the legality of the army. An army acting without a clear mandate from the Parliament would no longer be in the service of the nation, but of an isolated executive power, in contradiction with the spirit of our Constitution and with Article 16 of the Declaration of Human Rights and of the 1789 citizen who consecrates the separation of powers as guarantor of the rights: « No company is guaranteed, no guaranteed, no of rights.

This is why we, citizens and former military, believe that the Parliament should be consulted on the continuation of the French military intervention and/or its commitment in Ukraine, in accordance with Article 35 of the Constitution and that it must also be called to ratify the Franco-Ukrainian security agreements of February 16, 2024, in accordance with Article 53.

Proposed resolution:

We, citizens and former military, ask deputies and senators:

  1. To publish in the Official Journal all the information regarding the presence of French troops in Ukraine since 2022, according to article 35;
  1. To organize a debate followed by a vote on the continuation of this intervention, in applying article 35;
  1. To decide on the ratification of the Franco-Ukrainian security agreements of February 16, 2024, in accordance with Article 53;
  1. To register this resolution on the agenda within 15 days from its submission, in order to ensure the full exercise of the parliamentary control.
