Former top managers Miel were sentenced for fraud with an elite village
The Zamoskvoretsky District Court of Moscow ex-owner and founder of the MIIL Group Grigory Kulikov and the former vice president of the company Savely Orbant sentenced to seven years in general. They were found guilty of embezzlement in 2007-2008 over 85 million rubles. In investors, the not-so-built elite cottage village “Barviha-Villadge” on the Rublevo-Uspensky highway. Lawyers categorically deny lawyers, about to appeal the court decision.
The announcement of the verdict was attended by only a few victims, the prosecutor and lawyer Grigory Kulikov – Evgenia Filippov. In absentia, the Lord Kulikov and Orbant lived in absentia, they live abroad, Russia was refused them.
From the announced descriptive and resolving parts of the sentence, it followed that the former chairman of the board of directors of MIIL CJSC Grigory Kulikov and the head of the company MIIL – suburban real estate, Savely Orbant, were found guilty of particularly large fraud (part 4 of article 159 of the Criminal Code) and sentenced to seven years in a general regime colony. At the same time, the term of conclusion of both will be calculated from the moment of detention of convicts in Russia or after their extradition from abroad.
On the eve of the debate, the prosecutor asked them to be sentenced to nine years in prison, and at the same time to satisfy the claims of eight co -westers of an elite village recognized by the victims, from 7 million to 118 million rubles. Their statements to the Moscow police served as the basis for the initiation of a criminal case back in 2012.
The village of Barvikha-Viwoodzh, consisting of 3-8-secto-sectioned co-towhouses with all the corresponding infrastructure, was supposed to be built 10 km from the Moscow Ring Road per 6 hectares of land. For the project in 2007-2008, it was possible to collect about $ 70–80 million from potential buyers. Moreover, sales were so successful that 65 were bought out of 100 houses. However, the construction started due to lack of funds was terminated.
There are still unfinished houses on the territory, already overgrown not only with tall grass, but also in places in the forest.
After the appeal of the victims and the initiation of the case, the police conducted searches in the offices of the Miel holding, as well as in the apartments and houses of its top managers. As a result, the investigation came to the conclusion that the leaders of Miel, initially « unable to fulfill the obligation, deliberately misled the investors regarding the real state of things, concluding unfulfilled contracts with them. »
One of the reasons for the « financial difficulties » of that period was the loan of 500 million rubles taken in 2007 in Rosbank. At the same time, he was issued on the security of land in the still not erected village. However, the debt was not repaid on time, and in May 2011, Rosbank recovered $ 24.5 million from Miel.
Meanwhile, the funds raised from buyers, the investigation, went to another project by Grigory Kulikov – the development of the anniversary microdistrict in Khimki.
As a result, only some investors managed to return their money.
In turn, lawyers argued that the basis of the case is exclusively civilian conflict. At the same time, the lawyer Grigory Kulikova said that her client back in 2012 noted that in addition to the loan not returned on time, Miel was influenced by the mistakes made by his leadership. Allegedly, Savely Orbant sent part of the money of Barvikha-Viwage investors to buy another land plot, which « led to serious consequences. » The court, on the other hand, found the guilt of the correspondence defendants proven.
It is worth adding that the former head of the sales department of the MIIL Group of Companies Lyudmila Arkhipova and the commercial director of Miel – Zagorodnaya Real Estate Sergey Kasatkin were the first in this case in September 2016. The court admitted that they also participated in the embezzlement of the funds of Barviha-Villadge investors.
Evgeny Filippova’s lawyer told Kommersant that the verdict was sentenced, despite the fact that the statute of limitations had expired in the criminal case. According to protection, Mr. Kulikov did not violate the law, but was held accountable only because he was the founder of the Miel holding.
