Former police officers are accused of conspiracy with apartment scammers

From 12 to 24 years, the colony requested a state prosecution in court for the alleged participants in the organized criminal community (OPS), which, according to investigators, illegally captured two and a dozen Moscow apartments for several years with a total value of 260 million rubles. Machinators, in the case file, were also facilitated by three police officers, whom the prosecutor proposed to send from 16 to 18 years to the colony.

The process in the case of a criminal community began in the Moscow City Court in October last year. Before the Judician triple, the alleged organizer of the OPS Rafael Khamidullin, his two alleged henchmen, as well as the former head of the Ministry of Internal Affairs of the Presnensky district, Colonel of the police, Andrei Tolkach, deputy head of the criminal investigation department of the same department, Major Ruslan Danichenko and their colleague Andrei Velichko appeared. In addition to participation in the OPS (Article 210 of the Criminal Code of the Russian Federation), the defendants are charged with complicity in particularly large fraud (part 4 of article 159 of the Criminal Code of the Russian Federation) and human abduction (Article 126 of the Criminal Code of the Russian Federation).

Based on the case file, Rafael Hamidullin put together a criminal community for scams with the apartments of Muscovites in 2011.

The scheme of fraud, according to investigators, was a simple. The defendant got acquainted with the wipers who worked in the Presnensky district of the capital, and for a small fee received information from them about “dysfunctional apartments”, in which asocial elements lived. After that, the attackers suggested that owners of housing move them for good rewards in cheap apartments or outdoors and deceived. Meanwhile, with the help of acquaintances of law enforcement officers, the head of the OPS, on the case file, issued the apartments for himself or dummies (some of them are listed), and then rented apartments, and in those that were located on the lower floors, even equipped the saunas.

Over time, the FSB officers drew attention to the active buyer of housing.

The operatives found that Rafael Hamidullin took possession of almost 50 apartments in the center of Moscow, while half of their former owners dropped out in an unknown direction.

In August 2019, the fraud was detained. In 2022, the Khoroshevsky district court of the capital sentenced Rafael Khamidullin and his six accomplices to an impressive conclusion.

A year later, the convicted Hamidullin wrote a confession in which he reported not only about the facts of fraud with Moscow housing, but also about the participation of police officers Andrei Tolkach, Andrei Velichko and Ruslan Deanichenko. In November 2023, they were detained and, by decision of the Presnensky district court, were sent to a pre -trial detention center.

It is worth noting that law enforcement officers had already entered the view of investigators earlier, but in the first criminal case they were witnesses. Six months before the detention, Major of the Police Danichenko was fired from his post for negative reasons, and Andrei Tolkach left the Presnensky OMVD to the post of acting head of the linear department of the transport police.

During the investigation of the second case of the OPS, almost half of the episodes of fraud was excluded from its materials due to the expiration of the statute of limitations.

As a result, the participants of the scams were blamed for theft of only 24 metropolitan apartments and another in the Moscow region, as well as two land plots and cash contributions of the five dead.

The total damage caused to the city and the victim amounted to at least 260 million rubles.

In the debate, the prosecutor demanded to be sentenced to Rafael Hamidullin, taking into account the previously received period of a maximum security colony, two of his civil accomplices – to 12 and 15 years in a colony of general regime, and former police officers, Deanichenko and Velichko – by 18, 17 and 16 years of the strict regime, respectively.

Ex-police guilt did not admit. Lawyer Mikhail Trepashkin, representing the interests of Ruslan Deanichenko, said that his client had only indirect attitude to two episodes of the case, which took place in August and December 2015. In the first case, the major sent the alleged swindlers to the subordinate, who allegedly helped them in the transaction. And in the second, the ex-policeman simply bought an apartment from Rafael Hamidullin for his mother, which was also later seized with a mosimuity.

In turn, Andrei Tolkach’s lawyer Irina Kharitonova claimed that there was no data in the case that the police were aware of the criminal intentions of the Hamidullin group.

She noted that he, in the investigation and in court, claimed that he used the services of law enforcement officers at all, without revealing them his plans.

Rafael Hamidullin himself actively protested against the invaluant to him “OPS organization”. He insisted that the criminal community could not be in principle, since he did not disclose his plans even to the nearest accomplices, but used them as one -time guarantees for a fee. Therefore, according to him, he made up the apartments.

The sentence is scheduled for June 3.
