Former CEO of JSC Trust Moselectrotyagstroy received a suspended sentence
By the five -year conditional time, the Dorogomilovsky court of Moscow sentenced the former general director of Trest Moselectrotyagstroy JSC Nikolai Mirny. He was found guilty of embezzlement of funds in the performance of contract work under a contract from the Ministry of Defense in Kubinka near Moscow. The defendant did not plead guilty, insisting that he did not control the activities of the branches of his company near Moscow and did not dispose of their means.
Nikolai Mirny did not appear to be announced to the sentence. As his lawyer Irina Chekasina explained, on the eve of her 66-year-old client became bad with his heart and he called an ambulance. “And the doctors insisted that Nikolai Grigoryevich lay down in the hospital,” the defender said.
The announcement of the introductory and resolving parts of the sentence was brief.
According to the court’s decision, Nikolai Mirny was found guilty of fraud, committed on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation), and sentenced to five years in prison with a trial period of four years.
The lawsuit of the victim-the chief military construction department No. 14 (GVSU-14)-in the amount of 36 million rubles. He was forwarded to civil proceedings. In the debate of the parties, we note, the state prosecution proposed to condemn Nikolai Mirny to seven years of a general regime colony. Based on the case materials, Nikolai Mirny committed the crime for him during the execution of contracts for the construction of objects in Kubinka near Moscow, concluded in 2014-2015 by his company with GVSU-14.
The investigation considered that as a result of overstating the rates, as well as non -fulfillment of the full volume of work, the defendant appropriated at least 36 million rubles.
Nikolai rejected the peace claims. In particular, he stated that he acted strictly within the framework of his job descriptions and did not dispose of the funds of JSC single -handedly: according to the charter of the company, the financial units of the company did not obey him. The ex-get director also indicated that the branches of the JSC near Moscow were individual legal entities and independently conducted their financial and economic activities. The head company, the accused claimed, controlled only the expenditure of cash by subsidiaries, transferred by the latter for the execution of state contracts in order to prepare reports to the Ministry of Defense and the general contractor GVSU-14.
The lawyer Irina Chekasina reminded in the debate that during the proceedings the financiers of JSC called to the court confirmed the testimony of Nikolai Mirny, that he did not give instructions on transferring money.
The defense also pointed out the numerous merits of the defendant and his state and departmental awards – the medal of the Order “For Merit to the Fatherland” of the II degree, the Order “For Merit in Construction” and the medal “For Merit in Transport Construction” of the II degree.
His lawyer called the peaceful punishment the conventional punishment. « In fact an excuse. »
It is worth noting that this is the second process in which Nikolai Mirny was the defendant. In June 2023, the Tushino District Court of Moscow sentenced him to three and a half years of conditional imprisonment, finding guilty of the embezzlement of 13 million rubles.
