Fine 500 thousand euros of state for a crash with pl*cakes
A court ruling that forces the state to pay 500,000 euros for an accident with no consequences for life has aroused the indignation of Prime Minister Edi Rama, who called it a « gaffe » of justice. The ruling for which Rama accuses justice was given by Vlora Judge Hector Sinanaj in December 2020 and was upheld by the Tirana Appeal Judge Marsela Dervishi this month.
It is about an accident that occurred in August 2017, at the Vlora-Bishop Street Ship, where 6 women were involved, relatives. Eglantina Demiraj, a first -place passenger, was injured, while others escaped without injuries. The car driven by Nikol Kacaj went out of the way and ended up in the canal.
In the decision of the Vlora Court, which states that the injured Eglantina Demiraj suffered damage to the spine, difficulty in moving legs, which lead to temporary job loss. The accident, according to the court, was due to the works being carried out on the road and the lack of signage.
The respondent and who, according to the court ruling will have to pay compensation, is the Albanian Development Fund, despite the fact that the road works were entrusted to a private company. In the argumentative ruling of the Vlora Court, announced on 24 December 2020, the fault falls on the fund, as “the construction permit has come out on behalf of this institution, and that it is considered responsible for the development of the project, its supervision and implementation. Any damage caused to third parties, by the use of this road segment, has been assessed as a burden to keep.
