Ex-General FCS received 10 years for bribes
Ten years of colony, a fine and deprivation of the title-such a punishment, a military court in Moscow appointed a former chief fighter with corruption in the Federal Customs Service (FCS), Major General of the FSB Dmitry Muryshov. He was found guilty of receiving bribes from participants in foreign economic activity. The intermediary – entrepreneur Dmitry Nesterenko – received seven years. Immediately after the announcement of the sentence, convicts and their defense filed appeals.
In Moscow, the 235th garrison military court sentenced the case of Major General Dmitry Muryshov and the director of the Vector FROT LLC Dmitry Nesterenko. In the debate of the parties, the prosecutor asked to find Mr. Muryshov guilty of receiving bribes for a total of about 6 million rubles. (part 6 of article 290 of the Criminal Code of the Russian Federation), and Mr. Nesterenko – in mediation according to one of the episodes of bribery (part 4 of article 291.1 of the Criminal Code of the Russian Federation) and appoint a maximum security colony for the first 15 years, and the second – 10 years.
At the time of prosecution, Dmitry Muryshov held in the Federal Customs Service the position of head of the Corruption Office. According to the prosecutionthe criminal intent to receive bribes from him in January 2022. It was then, the case says, the general decided to receive 700 thousand rubles. and $ 20 thousand per month from two « participants in foreign economic activity » (FEA).
According to the plan, the bribe giveers were supposed to throw envelopes with money into the mailbox of a former FCS employee Konstantin Kolganov.
From where they were supposed to be taken from intermediaries, among which Ilya Zorokov and director of Vector FRT LLC Dmitry Nesterenko, previously convicted of fraud, were listed. The investigation considered that the general received the first bribe in August 2022, and the second in October-November of the same year. Then the general, according to investigators, decided to change the fee, demanding 700 thousand rubles. And $ 25 thousand, and immediately in December and January.
However, the participants in the criminal scheme did not know that by that time Ilya Korokov had been in the development of metropolitan Chekists for several months. And when in early December 2022 Dmitry Nesterenko took 1.4 million rubles from Konstantin Kolganov. And $ 50 thousand and transferred them to Ilya Zorokov, the latter was detained. Ilya Zorokov immediately went to cooperate with law enforcement officers, saying that the money seized from him was intended for Dmitry Muryshov. And although the detainee did not manage to transfer the funds further, Major General and entrepreneur Nesterenko were also taken into custody.
Dmitry Muryshov did not plead guilty to the investigation or in court. In particular, he stated that, according to his official duties, he could not influence the work of participants in foreign economic activity, his functions included only a verification of colleagues for committing those offenses. Accordingly, there was no need to pay him. And Ilya Zorokov, who gave him testimony, had previously been convicted of fraud and could simply hide behind the general and promise businessmen the patronage of the FCS leadership in order to bred them for money.
Konstantin Kolganov, in turn, could have stipulated the general, because at one time he was fired from the FCS on “discrediting grounds”. Accordingly, lawyers noted, this applicant was quite able to hide the offense on Dmitry Muryshov.
Dmitry Nesterenko also did not plead guilty.
He insisted that he did not know at all that there was money in the package, and even more so since they could be intended for Dmitry Muryshov, since he himself handed over the package to Ilya Horokov.
The court, however, did not accept the arguments of the defense and sentenced Dmitry Muryshov to ten years in a maximum security colony and a fine of 15 million rubles. At the same time, he was deprived of the title of Major General, and after dismissal he could not occupy a civil service for three years. His accomplice Nesterenko received seven years of a maximum security colony with a fine of 6.3 million rubles.
Immediately after the announcement of the court decision, the defense filed a complaint against the sentence. They say, in particular, that the court of first instance did not take into account all the circumstances of the case. So, the lawyer Dmitry Muryshov Vadim Yalovitsky indicated that the alleged bribeles-representatives of Ostashkov Export LLC and Five Planet LLC-did not experience any problems with the implementation of foreign economic activity in 2022, which means they did not need anyone’s patronage. In addition, the lawyer Yalovitsky noted, not a single fact of Dmitry Muryshov received money in court.
According to the defender, if the general was transmitted in October 2022, then this was not money, but the medicine “Oraltek”, prescribed by Major General by his attending physician allergist from the Federal State Budgetary Institution “SCTS Institute of Immunology of the FMBA of Russia”.
In November, souvenirs were transmitted to Mr. Muryshov: Ilya Zorokov (already convicted for seven years) delivered dishes with Christmas symbols in the package, which was recorded by operatives.
Especially lawyers emphasized that the participants of the foreign economic activity collected and transferred the money not for Major General, but for Ilya Zhornokov, while representatives of the firms-binders themselves « could not name not only the powers of Dmitry Muryshov, who allegedly transferred millions of rubles, but also the position held by them in 2022. »
“My client not only did not find money, allegedly transferred to him as bribes, but also accounts in banks, expensive property and in general of some luxury items,” Yalovitsky’s lawyer told Kommersant. “Despite the general lived with a disabled wife in an official apartment.”
In the appeal, lawyers will ask either to justify the clients, or cancel the sentence and send the case for a new consideration.
