In the effort for faster asylum procedures, the EU Commission wants to simplify it to send those seeking protection back to third countries-even if they only briefly traveled there. So far, asylum seekers have had a close connection to such a third country, for example through family members or a longer stay. In the future, it can already be sufficient that the person concerned had crossed the country on the run before the EU reached it, the Brussels authority said. The EU Parliament and the Member States still have to agree to the proposal.
According to the Commission, a sufficient connection to a secure third-party country should in future be in two ways: Either the data subject has traveled there on the run-or the EU country has concluded a corresponding agreement with the third country. In both cases, return could be possible. Unaccompanied minors are excluded.
Before a Member State concludes such agreements, he should inform the Commission and the other EU countries. This is intended to prevent individual states from creating regulations that do not correspond to the EU standards.
Acceleration of the procedures
The aim is that Member States can classify asylum applications more easily than inadmissible – and send back to countries in which they could already receive effective protection. In this way, procedures are to be accelerated and the national asylum systems are to be relieved. The Commission emphasized that fundamental rights and legal guarantees for applicants should remain preserved.
According to the Brussels authority, it depends on protection against rejection, access to asylum procedures and the lack of serious dangers of life and freedom – for example, based on origin, religion or political conviction, according to the Brussels authority.
Part of the EU migration pact
In addition, the Commission suggests that an objection to rejection of an asylum application will no longer automatically have a suspensive effect. This means that even if those affected legally proceed against a decision, they could already be returned. This is intended to avoid long procedures and blockages.

The Brussels authority’s proposal is part of the pact for migration and asylum. The Commission is implementing an obligation to check the concept of the safe third country until June 2025.
