Eight years in prison for the man who killed a young man in a young man in Granada | Spain
Brando Jiménez Heredia has declared himself guilty of the homicide of Juan Castro Trujillos, a 19 -year -old university student who in the early hours of August 15, 2022 had the bad fortune of crossing at the Illora Fair (Granada, 9,918 inhabitants) with Jiménez Heredia and some relatives and friends. That morning, Juan Castro received a punch from Brando Jiménez, now with 26 years, which caused death a few minutes later. This Monday was the trial with jury in which prosecution and accusations originally requested 15 years in prison for the accused. Finally, an agreement between all parties, which includes the victim’s family, has led to a sentence of eight years in jail for Jiménez Heredia, the exile for 15 years of the Andalusian town, in addition to the impossibility of communicating or approaching the family during that time and compensation of 120,000 euros for the parents and 75,000 for the deceased’s brother.
According to Europa Press, relatives have assured at the exit of the trial that they have preferred to reach this agreement to avoid « recalling very complicated facts for the family. » The events began after 6.30 am on that Monday of August, when Juan, his girlfriend and a group of friends enjoyed the fair of their people. One of those friends unwittingly shed a drink about a friend of the now convicted. The spirits were altered and the situation rose in tone so that Juan’s friends left the place. The other group pursued them and shortly after, Brando Jiménez found Juan.
According to the prosecutor’s story, the author of the events grabbed the victim for the clothes « at chest height », hit him in the face and said « or tell me where your friend is or I kill you. » At that time Juan’s girlfriend, who was beaten by Jiménez and was also injured. Then, the now convicted – « assuming the high probability that this was going to cause death, » the prosecutor describes in the brief in accordance with, « he gave (the victim) a very strong punch on the left side of the head, which caused death irremediably. » The young university student fell to the ground where Jiménez continued kicking him, to flee below. Minutes later, when medical services transferred him to a hospital in the capital, on a 40 -kilometer journey, Juan died.
The security forces began a search for the murderer who ended at noon on Tuesday, 24 hours later, when Jiménez Heredia gave himself to the Civil Guard. Since then, he has been in prison until he turns two years and almost nine months that he will now be discounted from the conviction. The family said at the time that everything had been an accident. At the trial, the conviction has taken the floor to apologize to the victim’s parents and relatives and has assured that he did not want that to end.
That morning of Fair, Jiménez was then – « slightly », according to prosecution – under the influence of alcohol and drugs. Three years later, that has served as an attenuating circumstance of his criminal responsibility on this homicide, which means killing someone without intentionality or by recklessness, in the face of murder, which includes premeditation and intentionality. It has also been considered by the parties when reaching the agreement the mitigating reparation of the damage, since Jiménez has already recorded 10,000 of the 195,000 euros that he must deliver to the relatives of Juan Castro.
It lived that summer this homicide in a very agitated way. The parties were suspended, and the surprise for what happened followed demonstrations in the streets of the town. Finally, a couple of days after that fateful morning on Monday, a group of people attacked the domicile where the condemned – an illegally occupied housing – and razed with everything, leaving the housing inhabitable. By the time that happened, the relatives had already left, in a voluntary exile.
