Details of the criminal case of managers and co-owners of PJSC TGK-14
“Kommersant” became the details of the criminal case of the leaders and co-owners of PJSC TGK-14 (provides heat and electricity to Buryatia and Transbaikalia) Konstantin Lulchev and Viktor Myasnik, detained for a particularly large fraud. According to investigators, the heads of the generating company and shareholders of owning its Far Eastern Management Company (DUK) overshadowed the heat tariffs for two years, due to which the two Rostec enterprises suffered losses of 9 million rubles. However, it is possible that in the future the number of victims and the amount of damage will increase significantly. Mr. Lulchev, according to some reports, called what was happening a raider seizure and declared a hunger strike as a sign.
According to Kommersant’s sources, Konstantin Lulchev was detained in Chita when trying to fly outside Russia, and Victor Myasnik in Moscow, by which he moved to Rolls-Royce. According to the interlocutors of Kommersant, Mr. butcher is going to send in Transbaikalia, where the main investigative actions are underway. Previously, it was the investigators of the local Ministry of Internal Affairs that opened a criminal case of fraud on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation). The reason for him was the results of inspections conducted by employees of the Economic Security Service of the FSB, economic security units and counteracting corruption of the Ministry of Internal Affairs, as well as the prosecutor’s office.
The reports of the operatives, as well as the statements of representatives of two large enterprises from the structure of Rostec and became the basis for the decision to bring to criminal liability of the gentlemen of Lulchev and the butcher, as well as persons who are in the case as unidentified. According to the investigation version, from January 1, 2022 to December 31, 2023, attackers deceived the regulatory authorities of the Republic of Buryatia and the Trans -Baikal Territory, transmitting « incorrect data in tariff applications for the establishment of tariffs for thermal energy. »
It is especially noted that the leaders of the generating company with their unidentified accomplices “from among the employees of TGK-14” acted “deliberately”, “a group of persons by prior conspiracy from selfish motives and with the aim of theft of cash received from consumers”.
As a result, they received “economically unreasonable profits”, and JSC Ulan-Udan Instrument-making production association and JSC “Ulan-Uda Aviation Plant”-damage in the amount of more than 9 million rubles. The first of them specializes mainly in the production of high -precision products for the aircraft industry and the needs of the Navy, and the second for more than 80 years has successfully produces helicopters, including the military.
According to preliminary data, Konstantin Lulchev expressed sharp dissatisfaction with the actions of operatives and investigators who announced him about the detention at 48 hours on suspicion of committing crimes, and even called the raider seizure.
After that, in protest, he allegedly declared a hunger strike.
At the same time, according to Kommersant sources, two injured enterprises can become the “first swallows” in the long list of potential victims of the tariff scam, and the total damage from it can increase many times to billions of rubles. According to data that are now being checked by special services, the Konstantin Lulchev family permanently lives in London, and the energy sector itself has an ID card for living in the UAE. He explained its presence by the need to open accounts there. His alleged accomplice Viktor Myasnik supposedly has real estate in Spain, where he also acquired a residence permit. At the same time, according to some reports, he tried to sell his shares in the generating company for about 1 billion rubles, but he did not find buyers.
As expected, in the near future, investigators will appeal to the court with motions for the arrests of the suspects.
It is interesting that a year ago, investigators of the Ministry of Internal Affairs already showed interest in the leaders and co-owners of TGK-14. Then, in the Internal Affairs Directorate in the Central District of Moscow, a criminal case was opened on abuse of authority (Article 201 of the Criminal Code of the Russian Federation) again on the basis of an audit of the FSB of Russia and statements of a number of minority shareholders of PJSC TGK-14.
Gentlemen Lulchev and the butcher became its co -owners, having bought stocks from Russian Railways three years ago. Then the DUK in Promsvyazbank took a loan of 3.211 billion rubles. for the acquisition of 92.21% of TGK-14 shares. A prerequisite for the provision of a credit line of the DUK was the guarantee of TGK-14 on security of its property.
The investigation had suspicions that the property of TGK had a pledged at the low value.
According to experts, the “economic feasibility” of the pledge was absent, since the sale of TGK property, if the loan agreement was not fulfilled, “would clearly negatively affect the operations of PJSC TGK-14 up to the impossibility of carrying out current activities for the heat and electricity of residents of the Trans-Baikal Territory and the Republic of Buryatia”.
In addition, the DUK with the authorized capital of 10 thousand rubles. At the end of 2021, she had very modest indicators. The annual revenue of the company amounted to only 9 million rubles, and profit – 0.85 million rubles. Perhaps the only thing that was associated with energy was the figure of Mr. Myasnik, who from 2010 to 2012 held the position of vice-governor of the Primorsky Territory in Energy, in 2015–2017 headed TGK-14, and then led the Directorate of overhaul and reconstruction of electrification objects of Russian Railways. Meanwhile, TGK-14, having passed the control of the gentlemen of Lulchev and the butcher, transferred 3.226 billion rubles. to repay the loan of Promsvyazbank.
Thus, the purchase of TGK-14 shares from one shareholder by another was allegedly funded by the most generating company. And DUK, due to its financial condition, did not have the opportunity to pay more than 0.1% of the loan per year.
In this investigation, Lord Lulchev and the butcher remained witnesses, although they were checked for the possible withdrawal of TGK-14 assets.
As Kommersant sources close to the investigation say, the FSB interest in the new owners of TGK-14, possibly prevented the collapse of the “system-forming enterprise”, which engaged in the “operation of critical infrastructure” and did not allow the preparation of the heating season 2025–2026.
