Curvature. The death of a 48-year-old during police intervention. There is an indictment
The tragedy took place on October 29, 2024 in the town of Krzywizna near Kluczbork (Opolskie Voivodeship). The owner of one of the local companies called the police to the fussing 48-year-old Ukrainian citizen. The reason for the quarrel was the issue of settling the receivables for accommodation between Ihor S. and his would -be employer. When the police arrived, things took an unexpected turn.

– After arriving at the place of a two -person police patrol, Ihor S. was called to show a document to confirm his identity. When he refused, the police reported that refusal to provide data, presenting an identity document, may result in liability for an offense (Article 65 § 2 kW) – (misleading a state authority or institution – ed.). Despite this, Ihor S. still did not comply with the command addressed to him, and then attempted to dismiss the intervention – informs Stanisław Bar, spokesman for the District Prosecutor’s Office in Opole.
At that time, one of the policemen, 29-year-old Maciej W., used the means of direct coercion against the Ukrainian through the use of « incapacitation techniques, i.e. neck celebration, while bringing a man to a lying position. »
– Due to the fact that he continued to put active resistance, tearing up and struggling, Maciej W. kept the overpowering handle, pressing the man with the weight of his body to the ground. After putting on handcuffs clipping their hands in the back, the police stated that Ihor S. was not breathing – reports a spokesman for the prosecutor’s office.
Policemen began resuscitating a man, which was then continued by the emergency team. However, the 48-year-old’s life could not be saved.
The autopsy showed that the death of Ihor S. occurred as a result of suffocation as a result of « strong, direct, mutual compression of the neck organs. »
The policeman « exceeded his rights »
Investigators found that Maciej W. exceeded his rights as a police officer by « using a means of direct coercion without being particularly careful and not taking into account the properties of the measure used sufficiently. »
– In the light of the reconstructed facts, the celebration of the neck used was too strong and long -lasting (it lasted about three minutes), which caused the hypoxia of the brain, the injuries of the cervical organs stopped, and consequently to his death by suffocating violent in the form of choking, « said Stanisław Bar.
Maciej W. did not confess to the act accused of him, and he presented his intervention as adequate to the situation and carried out with the right strength and for a short period.
The accused policeman is punishable by three months to five years imprisonment.
