CSM, after the decision of the deputies regarding the retirement of magistrates at 65

« It is unacceptable that in a rule of law, a member of the European Union, the Independence of Justice will constitute a predilent topic of discussion in the election campaign ”, shows in The communiqué of the Superior Council of Magistracy regarding the changes made by the deputies of the Pensions of the Magistrates.

« All the changes envisaged in the current parliamentary procedure are in an obvious contradiction both with the principle of independence of justice, as well as with the other constitutional principles regarding the legal security and predictability of the normative framework, the protection of the legitimate expectations of the recipients of the law, the equality in rights and non-discrimination, as they were constantly underlined, »

The SCM considers that « the legislative power refers to the judicial authority through a serious approach that does not increase essential values of constitutional democracy and the rule of law », which « places in derision the principle of loyal cooperation that must characterize the activity of public authorities ».

The SCM also considers « incomprehensible the way in which from one day to another, fundamental elements of the status of the magistrate, which may generate irreparadable consequences in the judicial system », is essentially and integrated.

The plenary of the Chamber of Deputies adopted, on Wednesday, the draft law on the pensions of the magistrates, initiated by the leaders of the ruling coalition, with 259 votes ‘for’, one vote ‘against’ and 25 abstentions.
