Criminal charges against five people for public procurement abuses in PE « State Roads »

The Ministry of Interior has filed criminal charges with the Basic Public Prosecutor’s Office Skopje against five natural and one legal entity in relation to public procurement abuses for the selection of a physical security firm at 14 toll stations at the Public Enterprise for State Roads.

Criminal charges were brought against JB (54) from Kicevo, ER. (56) from Tetovo, EJ (61) from Tetovo, MB (48) from Skopje and DZ (39) from Tetovo and against a legal entity from Kicevo.

Against the then manager of the company from Kicevo and the legal entity an investigation has been launched into the crime of « abuse of public call procedure, awarding a public procurement or public-private partnership agreement » of Article 275-c of the Criminal Code, while for the other four-then the director of the company, one of the other under the company. They include abuse of power and authority and forgery of official documents – reads the statement of the Interior Ministry.

It is a public procurement contract concluded on 08.08.2022, which has committed to carrying out continuous physical security 24/7 at all 14 toll stations of the Public Enterprise for State Roads for two years. Although according to the signed the contract was obliged, he did not abide by the obligation and for the entire period of the contract was performed only partial physical security, usually only in the first shift, and the contracting authority invoiced services as if 24/7 physical security for the entire contract period until its termination was terminated.

The then director of the public enterprise was obliged to take care of the legality of the work and the application of regulations, statute and other acts, as well as to control whether the execution of the public procurement contract was in accordance with the conditions, but did not perform that duty and missed the debt of the public service holder.

Two suspected managers of the toll and control department, they also had the obligation to monitor the contract and its fulfillment, to control the performance, approval of work orders to carry out the service, shipment, monitoring of the quality of the services performed, and to check the invoices, and to make a report. Such controls were not fully carried out, and although they knew that security was only partially performed in the first shift, they signed the payment requirements for payment.

The second signatory of the contract was acquainted with the requested specification, but still approved the claims and authorizations, after which he approved the due invoices that were then realized in favor of the Security Agency.

In this way, the other suspects allowed the suspect to obtain the procurement suspect in the amount of 46,918,079 denars and caused damage of large proportions to the Public Enterprise for State Roads.
The Public Prosecutor submitted a proposal to the Basic Criminal Court for the first suspect, while the rest were proposed.
