Construction inspection is accelerated, 81 facilities must
In 2065 procedures, construction inspectors issued 312 inspection decisions for the elimination of irregularities, and in 81 facilities, the owners did not make the decisions issued and will need to be removed. Inspectors also reported that such development does not like, because the procedures for the removal of the facility are usually drawn very much, despite the fact that payment orders for misdemeanors exceed an average of a thousand euros.
So far, 701 inspection procedures have been instituted in inspection procedures. 312 inspection decisions were issued for the elimination of irregularities, 52 decisions on a fine of EUR 130,650, 81 decisions on the authorization of enforcement by another person and 112 decisions on the authorization of enforcement by cash. In addition, 77 misdemeanor proceedings were introduced, 16 misdemeanor reminders, 30 payment orders totaling EUR 31,000 and 18 decisions on a misdemeanor of EUR 64,350.
The average payment order was therefore over a thousand euros, a fine of over 2500 euros, and the average misdemeanor decision just under € 3600.
Removal of illegal objects
« The removal of illegal and inconsistent facilities in 2025 are conducted in accordance with the legislation and priorities of the construction inspection in enforcement procedures, » the Natural Resources and Spatial Planning Inspectorate reports.
There are currently 81 cases on the forced execution list. According to the criteria of the construction law, these matters are the highest on the list for the implementation of enforcement by another person. In all 81 matters, a regulatory decision and a decision on the authorization of enforcement by another person have already been issued to establish a legal situation.
This is where the process is extended. Taxpayers do not fulfill the ordered obligations within the time limit and in the manner specified in the decision, and therefore, by order on the authorization of enforcement, the inspector initiates an enforcement procedure intended to force the taxpayer to fulfill the obligations imposed in the decision.
Until 20 May this year, the construction inspection, together with the selected contractor, conducted two enforcement by another person. At the same time, inspectors in 99 matters carried out the enforcement themselves. In 46 cases, administrative permits were obtained or the facilities were legalized. In total, until 20, 147 irregularities were eliminated.
« The aim of the construction inspection is for the taxpayers to perform the enforcement on their own, since each enforcement procedure by another person is time consuming and represents an additional burden on inspectors, » they say at the inspectorate.
Directed control
Actions of directional controls are selected based on current substantive areas and risk assessment. The aim of the action is to find out and prevent greater violations and protection of the public interest.
There are currently three campaigns: Supervision of the construction start, control of the work of participants in the construction of facilities, and control of construction, use and accessibility of public use facilities. The campaign to control the prevention of unauthorized buildings of facilities in cases in which the initiative is not given was successfully carried out, since 139 of the planned controls were completed (the report on the campaign is under preparation, according to the inspectorate).
The control action over the installation of building materials will begin shortly. In the fall of 2025, the construction of a new low- and medium-level waste landfill (NSRAO) in Vrbina will be a joint inspection with the radiation and nuclear safety inspection, as part of the campaign to control the work of participants in the construction of facilities.
