Constitutional Court abolished the disciplinary punishment of judge Truban

There has been a violation of the right to judicial protection and the right to a fair trial.

Košice. Constitutional Court The SR annulled the order of the Supreme Administrative Court of the Slovak Republic from March 2023 on the disciplinary punishment of the judge Michal Trubanwhich currently runs a specialized criminal court.

Truban’s constitutional complaint was decided by IV. The Senate of the Constitutional Court, which returned the case with the annulment of the order to the Supreme Administrative Court for further proceedings.

According to the decision, the Supreme Administrative Court is also obliged to pay the applicant the costs of EUR 959.

The Constitutional Court adopted a complaint for further proceedings in April 2024, postponing the enforceability of the Supreme Administrative Court’s order into the final decision in the matter.

The Supreme Administrative Court Disciplinary Senate acknowledged Truban as a judge of the Specialized Criminal Court for a serious disciplinary offense when he did not exclude himself from deciding on custody for a Nitra entrepreneur Norbert Bödör.

He punished it by a half -year reduction of the functional salary by 50 percent. The Senate of the Supreme Administrative Court pointed out that the judge must announce his bias whenever one of the reasons is given.

Truban described the verdict of the Supreme Administrative Court as absolutely unacceptable. He stated that he had no proportion to the parties or the present case.

He perceived the disciplinary as a politically motivated in connection with the decision to not captivate Norbert Bödör into custody in the case of livestock.

In October 2020, the then chairman of the Specialized Criminal Court Ján Hrubala and the President of the Judicial Council of the Slovak Republic Ján Mazák filed a petition for disciplinary proceedings against it in October 2020. They demanded it to a lower -level court.

Minister of Justice Boris Susko He appointed Truban as chairman of the Specialized Criminal Court on 15 December 2024.
