Complaint about gender quota, MP Andia Ulliri claims the mandate from the May 11 elections
Andia Oliri, who was on the open list of Durres District, has filed an official complaint to the Central Election Commission (CEC), claiming the mandate of MP Arjan Ndoja, arguing that the gender quota was not respected in the distribution of seats. In her request, the current DP MP states that the ranking of the winning candidates, as currently reflected on the CEC’s official website, does not respect the gender representation clearly set out in the Constitution and the Electoral Code.
« Your action to declare elected Mr. Arjan Ndoja, who is first listed in the list of preferred votes, is contrary to the law and constitutes a violation of the constitutional principle for gender representation, » He writes to the CEC.
On the other hand, it refers to the latest legal changes adopted by the Assembly, where it claims through an amendment to the Electoral Code, that one in every three winning candidates on the list, after the preparaging voting, belong to the less represented gender. Olive points out that this interpretation is also supported by the Constitutional Court in its decision no. 85, dated 24.12.2024, where it is stated that the electoral list is one and only, divided into two parts for technical purposes, but that the final distribution of seats should be implemented the gender quota in the total list.
