Chamber of workers demands protection for all victims of domestic violence

« The Chambre of the Salariés Luxembourg allows the view that women have to be better protected, » said the equality committee of the Chamber of Labor in its statement on May 8 on the draft law of the deputy of Déi Lénk, Marc Baum.

The deputy’s draft law aims to improve the protection of victims of domestic violence. To this end, a « general and free legal aid for victims of domestic violence » is to be introduced. Marc Baum said this at the presentation of the draft in a chamber session in March.

The draft law of Baum also provides for a legal definition of « economic violence ». « Economic violence » is therefore to be understood to understand any violence, action or behavior that the victim brings in financial or material dependence on the perpetrator or inflicts economic damage to him.

Likewise, the MP wants the financial situation of the victims for access to the proposed legal assistance.

Criticism of the draft law

The Chamber of Labor welcomes both the universal and free legal advice and the additional legal definition of « economic violence ».

However, the CSL questions the proposed restriction, « which, if not exclusively, seems to be directed against women ». The draft proposed by Déi Lénk is not inclusive for the Chamber of Workers, since men and people from the LGBT+community could also be victims of domestic violence, albeit in a smaller number, according to the statement.

« The CSL wonders whether the latter (men and people from the LGBT+community) should not undoubtedly also benefit from the proposed protective mechanism. »
