Challenged and CCR suspension of election annulment decision
The Constitutional Court of Romania declared an appeal against the decision by which the Ploiești Court of Appeal admitted a request requesting the suspension of the CCR decision of 6 December 2024 by which the presidential elections were annulled.
According to data communicated on Friday AGERPRES by the Ploiești Court of Appeal, the decision was declared by the Prosecutor’s Office attached to the Ploiești Court of Appeal, the Constitutional Court of Romania, but also by two other natural persons who do not appear as parties in the file.
‘Given the information conveyed in the public space with reference to the situation of the actions requesting the suspension of the decision of the Constitutional Court 32 of December 6, 2024, until the final settlement of the case, as well as the annulment of this decision, we specify that, on April 10, on the role of the Ploiești Court of Appeal, the Fiscal Court – It was requested to suspend the execution of the contested administrative act, until the definitive settlement of each file, as well as the annulment of the Constitutional Court Decision 32 of December 6, 2024 ‘, informed the Ploiești Court of Appeal.
According to the quoted source, outside the file 301/42/2025, the file 300/42/2025 was solved, by sentence 133/23.04.2025, pronounced by another complete within the administrative and fiscal litigation section of the Ploiești Court of Appeal, by which the exception of the general incompetence was admitted, with the request, in court, as not being within the jurisdiction of the courts, a decision that is subject to the appeal within five days from the ruling.
Regarding the situation of the other nine files, four of them have set deadlines, on April 29, or, as the case may be, April 30, and five are in the preliminary procedure phase, not still having settled courts, the Ploiești Court of Appeal said.
On Thursday, a judge from the Ploiești Court of Appeal admitted an application requesting the suspension of the RCC decision of December 6, 2024 to annul the presidential elections.
« Admits the end of the request regarding the suspension of the execution of the contested administrative act. It suspends the execution of the Constitutional Court’s decision no. Right of appeal within 5 days of pronouncement ”, according to the minute of the decision.
