Elizenilde Oliveira, Brazilian immigrant, advanced this month with a complaint against the Portuguese State and the agency for integration, migrations and asylum (AIMA), for non -compliance with legal deadlines.

According to the lawsuit, cited by the Lusa Agency, the non -compliance with a period of 48 hours by the Lisbon Administrative Court “under an urgent judicial proceeding”, which will “compromise the applicant’s constitutional right” to an effective decision within a reasonable period, and which would allow Elizenilde Oliveira to be present at the birth of his granddaughter to be compromised.

In the case of AIMA, the action is arrested for breach of “legal deadlines” that “violated the duties of efficiency and speed” and caused it to “damage”.

The immigrant also told Lusa that she arrived in Portugal in June 2023 and presented her demonstration of interest on 13 November of the same year, but so far there is no residence title, and only scored at AIMA paying to a lawyer.

In this sense, Elizenilde Oliveira calls for compensation for moral damages suffered in the same period in the amount of 50 thousand euros, or an amount “to be arbitrated” in court. It also asks that the defendants are condemned to the payment of 5,000 euros, “with correction and legal interest”, respecting the defense fees.
