Now Bernhard Alpstaeg is ahead of the criminal court – public interest is great
Bernhard Alpstaeg defends himself against the allegations of coercion and tried unfaithful management. He does not answer any questions.
Later, however, it got serious. The court pointed out his lawyer that Alpstaeg will not answer any direct questions given his advanced age; Alpstaeg is 79 years old. So he wants to make no use of his right. He answered questions with « no answer ». Later, however, he sometimes deviated from it and sometimes replied in terms of content. For example, that he no longer knew something. Or that it was an “investment” that he made in the FCL. With increasing survey, Alpstaeg also made a somewhat nervous, sometimes annoyed impression. So he constantly bobbed with his red glasses, which he held in his hand. In the other hand he held a blue folder.

On the other hand, FCL Interim President Josef Bieri and FCL government councilor Ursula Engelberger were present. Former FCL shareholder Marco Sieber is still expected, the other former FCL shareholders Samih Sawiris and Hans Schmid were not on site. They are co -plaintiffs together with Marco Sieber and are represented by a lawyer. Josef Bieri and his confidants entered the courthouse through the main entrance, while the Alpstaeg team came into the negotiating room in an unknown way. It will be a monster process for everyone involved: hours of pleading, the process should last for hours, and the process should last until the evening.
Alpstaeg defends itself against punitive order
Alpstaeg defends himself against a penalty order on Wednesday against a criminal order that the public prosecutor’s office had spoken against: a bus of CHF 10,000 and a conditional fine of 100 daily rates of CHF 3,000 due to coercion and attempted unfaithful business management. This in connection with the stock package of 25 percent of FCL Holding AG, which Alpstaeg had taken over from FCL Honorary President Walter Stierli and made him a majority shareholder and thus club owners. In the room there is accusation that he could only get this 25 percent because he had put pressure on the then shareholders Hans Schmid, Samih Sawiris and Marco Sieber, as the FCL Board of Directors claimed. As a result, he took this stock package away Alpstaeg and disempowered it.
Alpstaeg now defends himself against these allegations, which is why he continued the judgment of the public prosecutor’s office to the next instance: on Wednesday he wants to obtain an acquittal before the criminal court in Lucerne. ATTENTION: This criminal process is not about who is now a legal owner of the 25 percent, this will be decided on a later civil process. But it is about the question of the circumstances under which Alpstaeg has its possession.
