Banking Dawidy. A police car accident with teenagers. The policeman heard the sentence
Policemen from Pruszków (Masovian Voivodeship) on Monday, January 2, 2023, received a notification regarding the fire. Returning from the intervention site, they took two teenagers to the police car from a group that was supposed to alert about a fire. Soon an accident occurred in the banking Dawidach in Warsaw – the police car crashed on the tree, and the girls – then 17 and 19 years old – were injured.

Janusz R., today a former policeman, heard allegations of exceeding his official rights – he took two teenagers to the police car, who were not undertaken by official activities (investigators confirmed that they were to get into the car voluntarily) and inadvertently causing an accident.
– The indictment was also covered by the allegation of Janusz R., which consisted in failing to fulfill the duties of a police officer by not helping the victims to women in the case of women – explained at that time « Fakt » Prosecutor Szymon Banna from the District Prosecutor’s Office in Warsaw.
The allegation of failure to comply with official duties by not helping the victim was also heard by the second policeman participating in the event Jakub S. Court at the request of the prosecutor’s office, which drew attention to his « side role » and attitude in the course of the investigation, decided in October 2023 on conditional discontinuation of the proceedings.

Before the District Court in Pruszków on Tuesday, June 17, a verdict was passed. Janusz R. was sentenced to a year imprisonment suspended for two years (the maximum sentence was three years). The man was also obliged to pay 9 thousand. PLN fine, as well as written apologies and paying for victims of 7,000 victims. PLN and 5,000 zloty. He will also have to cover court costs. This judgment is not final.
For me, this judgment is not fair. I was not expecting this and I feel disappointed
– says « Fakt » one of the victims as a result of women’s accident. He adds that her family and the second victims also have similar feelings.
– I was at several hearings, mainly compulsory ones, because for me it is very high stress. The whole situation generally caused me a lot of harm to my mental and physical health, so I did not want to get worse – admits our interlocutor.
Asked whether during those hearings at which she was, the accused showed repentance, he replies briefly: – Absolutely not. In my opinion, he doesn’t feel guilty at all. He doesn’t think what he did is bad.
« It hurts the most, because he is a policeman who should help, not hurt, » he emphasizes and admits that she has not even heard the word « sorry » so far.

As the judicial assessor Justyna Gabrysiak pointed out in the oral justification of the judgment, the fact that Janusz R. took two victims to the police car, moved away from the intervention, and that there was an accident, from the beginning it was indisputable in this matter.
The accused, however, was constantly to question the testimonies of the other witnesses and the evidence gathered regarding the reason why the victims got into the police car; Causes of loss of control over the vehicle and hitting a tree and whether he gave the victims to help after the accident.
The former policeman was to explain to the court, among others, that the accident occurred, despite the fact that he was moving at a speed in accordance with the traffic rules and that the injured were in the police car because they wanted to provide him with information about the circumstances of the fire. However, the court found these explanations unbelievable.
It is not known at the moment whether the prosecutor’s office and the injured will appeal against the judgment. However, Janusz R.
