Ayuso’s lawyer, in the Supreme: « He tells me that he understands what criminal compliance is and that forward » | Spain
The prosecutor Carlos Neira, the lawyer to whom the businessman Alberto González Amador – for Isabel Díaz Ayuso – To defend against the alleged crimes against the Treasuryhe said in the Supreme Court that he explained to his client to agree with the Prosecutor’s Office involved admitting crimes and that he approves him to do so. Neira’s version denies in part the one given by González Amador in the Supreme four days beforewhen he declared as a witness and assured that he and Neira only talked about the possibility of reaching a pact during a meeting in October of the year 2023. In that meeting, according to the Ayuso couple, the lawyer explained that there were two alternatives: defending themselves in court or seeking an agreement with the Prosecutor’s Office. The businessman said he asked Neira to do the best for the matter to be resolved quickly and discreetly so as not to harm his partner, but did not opt for any option and left him « open » to what the lawyer considered.
Neira, according to his statement in the Supreme, recommended to González Amador that, to achieve that objective of « causing the least possible damage » to the Madrid president, it was best to find a pact. And he explained in detail what he supposed: « You have to agree on facts (…) Logically, a conformity is a conviction, » said the lawyer, according to his own testimony. « He tells me that he understands what is a compliance and that ahead, that he already leaves it in my hands, » said Neira, who explained to the judge that « with that mandate » of his client sent on February 2 the mail to the Prosecutor’s Office of Economic Crimes in which he proposed a pact and admitted that González Amador had committed two fiscal crimes.
Neira did support the version of González Amador that he did not participate in the writing of that mail nor did he send him a copy once sent. « I chose the content I considered at that time taking into account my client’s commission, » said the lawyer. « I did not send it to my client, that is true, I was not aware that I had launched the procedures for the criminal compliance that he had authorized me. » The lawyer also confirmed that he sent the mail to a state lawyer with the intention of « expediting as much as possible the processing of that criminal compliance. »
A few days later, on February 12, Neira received an email from prosecutor Julián Salto, who informed him that he had been assigned the case and took note of his compliance proposal. The lawyer, as explained in the Supreme Court, told González Amador. Neira and the prosecutor spoke again three days later, when they agreed to close another pact in accordance with the Courts of Plaza de Castilla.
To questions from the judge, the lawyer also ratified the version of Ayuso’s couple that, when the mail filtered to the media on March 14, González Amador was “perplexed”. Neira reminded him then that he had already explained at the time what implied compliance and that he wrote the mail in response to what both had agreed a few days before.
Neira also assured that he taught González Amador his postal crossing with the Prosecutor’s Office when they were preparing the complaint filed by Ayuso’s couple against the Ministry, which led to the investigation against the Attorney General. But, according to the lawyer, he did not participate in that complaint, in which aspects were omitted that García Ortiz’s defense considers relevant.
