A number of regions will conclude concessions on the construction of garbage sorting without competitions
The government reduced the terms for the conclusion of concession agreements “for the construction of complex facilities of solid municipal waste (MSW)” – the garbage sorting complexes are officially called. In 19 regions, 36 such facilities will be built, agreements with the executors will be concluded without competitions in order to cut off unscrupulous participants. Constructs will be able to count on preferential financing of the REO PPC. The document is designed to speed up the influx in the private investment industry, but individual experts are confused by the non -competitive selection of participants in the agreements.
Government Published Order No. 649-r of March 20, 2025-the document is also necessary for the “restart” of the industry against the background of garbage collapses (on the extension priorities of the instructions of the “ecological” deputy prime minister Dmitry Patrushev « Kommersant » wrote on March 17). 19 constituent entities of the Russian Federation-Primorsky, Altai, Krasnoyarsk, Krasnodar Territory, Amur, Arkhangelsk, Kurgan, Orenburg, Samara, Yaroslavl, Tver, Kaliningrad Regions, Jewish Autonomous Region, Chukotka Autonomous Okrug, Karachay-Cherkess Republic, Altai, Ingushetia, Kalmykia, Komi republics, Komi Agreements without a competition with organizations from a list attached to the order.
The disposal requires the mandatory participation of the REO PPC in these organizers (apparently to ensure corporate control), the PPC will also ensure preferential financing, the intended use of funds and compliance with the construction time.
In total, in 19 regions 36 objects for TCO processing with a total capacity of 5 million tons will be built, 2.1 million tons of disposal, placement – 3.765 million tons, which will allow regions from the list almost completely to ensure the achievement of the indicators of the “Economics of the Closed Cycle” – 100% of MSW sorting by 2030.
“The order was adopted in connection with the difficulties of conducting investment activities in certain regions of the country and the absence of investors who are ready for long -term private investment in projects,” Kommersant Director Denis Butsaev explained to Kommersant. In the PPC, the REO is explained: the procedure for concluding a concession agreement on the competition takes about 135 business days with the exit to the construction no earlier than 10-12 months, and tightening the deadlines leads to a significant increase in projects.
Earlier, we recall, the Ministry of Natural Resources published a draft presidential decree on the expansion of the powers of the REO in the garbage industry (also in the list of priorities, See “Kommersant” from March 20). According to Irina Telnova from the Institute of Ecology, the Higher School of Environmental Ecology, a consequence of the growth of the administrative weight of the REO, however, may be « insufficient concentration of the company on issues related to its direct competence, which forced her to look for ways to increase efficiency with the help of opaque instruments. » “The branch of the processing of MSW in the Russian Federation is characterized by deviations from market principles,” says Alina Shleeva, senior lawyer of the propositum lawyer bureau, noting that “the government’s approach is unlikely to comply with the norms and logic No. 115-ФЗ (competition on competition. « Kommersant »), requiring competitive and adversarial selection of concessionaires. ”
However, the order “with the right approach” can also solve a significant part of the problems of concessionaires who are unprofitable to lose money – non -payments for garbage collection in certain regions reach 70%, said senior researcher at the Research of Sustainable Development of IPEI Rannakhs Sodna Budatarov.
If there were no people who want to build objects on a concession without the participation of RAO, “with them the REO PPC has at least understanding – how joint activities will be built,” the expert says, adding that the refusal of trading will exclude the participation of unscrupulous companies that can block the execution of contracts.
