Everything happened on Thursday, April 10, in Bydgoszcz. It was just after 5, when on the sidewalk at ul. The cyclist noticed a lying man. The 87-year-old did not give signs of life.
The man died on the pavement. Eight hours were waiting in place for the doctor’s arrival to write a death certificate
Emergency rescuers were called in, then the police. Everything indicated that the senior was dead. However, there was a problem with writing a death card.
This cannot be described. We are waiting here for hours, we cannot move because there is no doctor. Ambulance rescuers arrived but could not issue a death certificate

– Dad went to the stop in the morning. He was on his way to work because he earned some extra money. He did not get sick before, he recently mentioned something that he felt bad, but it is known how it is with people from this older generation – he said: calmly, I will sleep and pass. He was active. Only three months ago the voivode visited him, his father had 65 years of work behind him … And now such a thing – says the son of the deceased.

He says that the policemen who came to the place were doubled and tripled.
They called the clinics, after municipal institutions, contacted the crisis staff in the city of the voivode. And nothing, out of nowhere. There was nowhere a doctor who could get to the place and determine death. A policewoman was with us all the time. It was cold, and the wind almost overturned the screen that was sheltered by the body
– says the son of the deceased with pain.
It wasn’t until a dozen or so minutes after 13 o’clock that the doctor from a nearby clinic was brought to the place who wrote the death certificate.
– In fact, a police patrol was sent to a estate street. Policemen did their best to bring a doctor in their place – says comm. Lidia Kowalska from the Municipal Police Headquarters in Bydgoszcz.

The problem is serious and comes back from time to time. All because of unclear legal regulations. It seemed that something would change after the entry into force of the Act of December 1, 2022 on the profession of a paramedic and the self -government of paramedics.
Pursuant to these provisions, practicing the profession of a paramedic, including At the death of death that occurred during a medical action, so in practice it is assumed that this is the situation after taking medical rescue activities, e.g. after cardiopulmonary resuscitation.
Meanwhile, on April 10 on ul. Osiedle Medical Rescue Team « recognized the death at the scene that took place before the arrival of the ambulance » did not take medical rescue operations due to certain and irreversible deaths of death, confirmed death in the ECG record, performing the assistoly protocol, but found visible damage to the possibility of committing a crime and participation in the event of third parties.

– The paramedic could not find out and determine the causes of death for which the documentation obliges him, where he must enter the disease entity in the ICD10 category. The case was referred to the decision and further proceedings of the police – says Krzysztof Wiśniewski from the Provincial Ambulance Station in Bydgoszcz.
In addition, the rights of a paramedic to determine death arise from the Act of 31 January 1959 on cemeteries and hiding the dead. However, according to this provision, the duty of the medical rescue team manager is not only to determine death, write a death card, but also to determine the cause of death.
Adam Dudziak, director of the Crisis Management Department at the City of Bydgoszcz, also refers to these provisions.

In the Act of 1959, it was indicated, among other things, that the appointment of a doctor confirming death remains the responsibility of the staroste, which, however, when the act entered into force was a representative of government administration, not local government. We have been waiting for years to regulate this issue. Legislative work is underway, but so far the problem remains unsolved
– emphasizes Adam Dudziak.
– It’s a difficult situation. I can only convey words of deep sympathy to the family of a deceased man. On the same day, a police officer in Fordon contacted me, I know there was a problem. Unfortunately, this situation is repeated from time to time. We are also in contact with the voivode and we are waiting for the regulations to be regulated in this respect – emphasizes the director of the Department of Crisis Management at the Bydgoszcz City Hall.

The Ministry of Health ensures that « conducts activities aimed at comprehensive regulation by statutory issues related to the determination of death. » It is also about the coroner institution and the electronic death card, but these regulations are intended to apply only in 2026.
