A guilty and an acquittal- Diepresse.com
The initial accused was sentenced to 14 years in prison for attempted murder. He is said to have shot in a Viennese park on Syrians.
The process of a violent discussion between Chechens and Syrians last summer in a Wiener Park ended on Wednesday with a guilt and acquittal. The 30-year-old first-time sued, who is said to have shot on Syrian on July 5, 2024, was sentenced to 14 years in prison for attempted murder. His friend was acquitted of the contribution. The judgments are not final.
The two defendants were not confessed with the events in the Anton-Kummerer Park in the Brigittenau. The eight jury took almost four hours for the perception. On the second and last day of negotiations before the jury (chair: Wolfgang Etl), further witnesses and the shooting expert Ingo Wieser had their say.
Call data evaluation shows closeness to the crime scene
The men represented by the defenders Alexander Philipp and Florian Kreiner insured that they did not even enter the park after this was stormed by dozens with wooden slats, iron rods, machetes and other weapon -compatible Syrians. Call data evaluations of the accused’s cell phones had shown that they were at least nearby, with a deviation of one kilometer.
The 30-year-old was accused of having fired five opponents with a pistol at least six times. According to the indictment, the balls narrowly missed the Syrians. Two of them were injured by vehicles. One suffered a splinter injury, which is measured four centimeters, in the area of the sternum tip, the other a superficial crack squeeze on the right thigh.
Particles of sleeves go with traces of smoke in the car
The 30-year-old always denied the shots, he was near the crime scene, but would have driven away with his car as soon as he had heard the shots. However, traces of smoke were found in his car, which clearly match the particles from the seized cartridge sleeves, as Wieser explained on Wednesday. His justification that he regularly shot on a shooting range in Slovakia and the traces of smoke came from both the shooting range and the expert. None of the cartridges discovered at home would match the particles in the car.
The 29-year-old is said to have accompanied the main defendant, with whom he has been friends for 14 years. According to the indictment, the younger also armed himself at the scene, but he could not prove that he could use weapons. The indictment assumed that he had « confirmed the 30-year-old at least psychologically with his shot ». However, a friend of the 29-year-old said as a witness at today’s trial and emphasized that the man was eating with her near the Pizza park. After that, they would have sat on a bench near the Brigittenau swimming pool. Suddenly young Chechens walked past them. The 29-year-old spoke to them and went briefly. When the shots fell, he came back and said: « We should move away, » said the young woman. « Then we went to a cafe. » The two then observed the police operation.
Shooting appraiser Wieser stated that the murder weapon must have been a Walther P5, a weapon that has the fire sleeves on the left. The perpetrator shot six times. In addition, further bullet holes were discovered at a parking space that suggests that two more times were shot there. Since no sleeves had been found, it could be possible that the weapon was fired from a car. The expert could not say whether it was the same perpetrator or a second suspect. The cartridges all had a size of nine millimeters. In addition to the steering wheel, in the car of the first-time accuser, traces of smoke were also discovered on a belly pocket of the 29-year-old. Since they were only found in two compartments from the inner pocket, the experts assume that someone could have intervened with contaminated hands.
