A Bolsonarista tries to stop his extradition to Brazil at the National Court: « I never committed any crime » | Spain

The Brazilian Oswaldo Eustaquio Filho rises from the bench of the defendants and, relying on a crutch, is directed slowly towards the court. Once placed before the microphone and with a fixed view in the three magistrates of the National Court they must decide if they approve their extradition to their native country, which claims for participating in the alleged conspiracy led by former president Jair Messias Bolsonaro To give a coup against Luiz Inacio Lula da Silva, Oswaldo Eustaquio Filho cries his innocence. « I never committed any crime. I suffer from political persecution, » says the activist, who defines himself as « Bolsonarista », « writer » and « research journalist. »

This Thursday, the National Court has welcomed the view of extradition against Filho. The defense and the prosecution have requested that the request of the Brazilian authorities be rejected, who accuse him of joining a “campaign” through the Internet and social networks to “intimidate police officers”, specifically, a commissioner and their relatives. However, the Public Ministry opposes the claims of the South American country because, as stated, the expressions attributed to the activist « would not constitute a crime » in Spain « being protected by freedom of expression. »

« The right of freedom of expression and information is being intended to violate, » Filho’s lawyer insisted on Thursday. « In addition, mixed with political and ideological dyes. Precisely, because the situation of this new government is known and what is doing to proactivists of the previous government, » added the lawyer, who has also claimed that extradition be denied by a « formal defect », since the « necessary documentation » has not been contributed. In his last turn, the accused has riveted: « I arrived in Spain in 2023 and asked for political asylum for a very violent political persecution against me, my children and my ex -partner, who is in Brazil. I am a chased politician. If I am returned, I will be tortured. I was beaten in jail. »

Brazil imputes to the activist a crime « of violent abolition of the democratic state of law and coup d’etat. » As detailed by the Prosecutor’s Office, the authorities attribute the authorship of several messages spilled from July 2024 in the profile of his daughter in the social network X (formerly called Twitter), which he used to criminalize a commissioner and publish “personal data” of the Federal Police agent and images of his wife. For example, in one of those tweets he read: « The commissioner, who signed the accusation of Bolsonaro, stole my mother’s mobile in 2020. It is evil and violates the law to achieve her goals. He woke up my brothers and rummed up in my underwear drawer, mocking me. God will do justice. »

Another message, in addition to including the police photo, added: « This is the commissioner who for years managed to remain anonymous, without photos on the Internet. He is responsible for arresting innocent patriots and making thousands of children cry for his parents. He has entered my room to accuse Bolsonaro. » « From these publications, other profiles began to promote acts of exposure and intimidation » against the agent, using the expression of « living or dead », in addition to spreading data from other relatives, according to the extradition request of Brazil.

Once heard all parties on Thursday, the National Court must now decide if it approves extradition.
