The Agreement between US and Ukraine Governments « On the Creation of the US-Ukrainian Investment Fund » applies to 57 minerals, it also refers to military assistance from the United States, but a number of issues in the document are not detailed.

In particular, the bilateral agreement, signed in Washington on April 30, establishes political parameters of cooperation between two governments on:
- Development of subsoil,
- sales of fossils,
- American assistance, including military, which Ukraine will receive in the future.
However, many details, including those of political importance, will be prescribed in the Technical Agreement, which is now not ready for signing.
It is also noted that the agreement signed on Wednesday is laid out on only 12 pages. Whereas the previous project that The United States was transferred to Ukraine in Marchoccupied 90 pages in the same font.

« European Truth » emphasizes that the agreement really describes the guarantees that it will not contradict Ukraine’s agreements with the EU and Ukraine’s desire for accession. In case of contradiction in the entrance agreement with the European Union – the provisions of the US agreement should be revised.
It is important that the document does not subordinate Ukraine to the American legal system – disputes are resolved parity, on the basis of consultation.
There is also no « first hand right » for companies from the United States to obtain mineral resources in Ukraine. At the same time, US companies should have access to auctions or negotiations to buy such minerals on conditions not worse than other buyers.
The agreement stipulates a list of minerals, the production of which it concerns. It is about 57 names: aluminum, antimony, arsenic, barite, berry, bismuth, cerium, cesium, chromium, cobalt, copper, dysprosium, erbius, Europe, fluor Luttion, magnesium, manganese, neodymium, nickel, niobium, palladium, platinum, potassium, praseodima, rhodium, rubidium, ruthenium, Samarius, scandal, tantalal, tantal, tantur, Terbius, tolerance, tin, titanium, tolfram, uranium, vanadium, iterbius.
It is only about new deposits, licenses to which Ukraine will issue after the agreement enters into force. This list can only be expanded with the consent of the parties.
The agreement does not regulate the production and income from the extraction of other fossils. It also does not apply to Ukrainian infrastructure income, as the United States was initially offered.
Ukraine invests in a joint fund income from licenses and rent payments from the production of these fossils, but has the right to transfer funds there.
The US contribution will, in particular, new weapons supply to the Armed Forces.
« If (… US government) provides new military assistance to the Government of Ukraine in any form (including the transfer of weapons, ammunition, technologies or training systems), the US capital contribution will be considered increased to the estimated cost of such military assistance, » the agreement reads.
However, some of the rules stated by the prime minister are not described in the agreement. Yes, it is not mentioned in it About the principles of fund managementas well as the US obligations, not to raise income from the Fund for 10 years, but to reinvest 100% of Ukraine’s reconstruction. These positions should be spelled out in the next agreement, the text of which is prepared.
