The basic military servant speaks of an accident. However, the public prosecutor assumes a killing resolution.

After a 20-year-old basic military servant last October a colleague in the Turkish barracks in Spittal an der Drau Deadly injured by a shot had the murder trial against him on Wednesday. The media and public crowd at the Klagenfurt regional court was enormous, several visitors found no place in the large jury. The negotiation was scheduled until the evening. The young man threatens up to 20 years in prison.

In the afternoon of October 22nd, the fatal shot was in the Wachnokal of the barracks, in which the defendant had served since morning. After the later killed occurred, there was a short conversation between the two young men – according to the indictment, it is not known. The two young men had only fleetingly knew themselves before basic military service.

In the course of the conversation with the 21-year-old, the defendant suddenly took his service weapon out of the Holster « and pressed the deduction when the barrel was directed towards the chest of what was about two meters away, » says the indictment. The projectile penetrated the breast of the 21-year-old and stepped out again on the back. Despite rapid emergency medical help, the 21-year-old died of bleeding as a result of the lung shot in the shock room of the Klagenfurt Clinic.

Charge is based on killing intentions

The defendant had admitted the shot levy after his arrest, but declared that it was unintentionally. However, this was not understandable, the prosecutor referred to the defendant’s changing information in her indictment: At first he said that he fell down the arms belt, and a shot had come loose. He later stated that he was « frightened » when the later victim was entered – referred to a video, so the later killed was two minutes in the waking room before the shot fell.

Furthermore, the accused said that he noticed that something – probably the pistol – falls down. He then kicked this object up with one foot and got it briefly. The prosecutor referred to the multiple securing of the Glock: in the Holster there could be no shot and the weapon couldn’t just fall out of the holster. How exactly the defendant’s version had expired has not yet been clarified, because he had rejected participation in a talent reconstruction. The prosecutor also denied that there is no motive: « There is a motive, but we don’t know it. »

Defense: « Tragic misfortune »

The defendant’s defender, Kurt Jelinek, spoke of a « tragic accident ». The accused and the victim knew each other and also understood that there was no reason why his client should have killed his colleague. The 20-year-old is guilty of grossly negligent killing: « He created a dangerous situation with the weapon, which should not have happened. » Several times, the defense lawyer asked the family of the killed, who was also in the courtroom.

« We assume that it was really stupid, » said Jelinek to the course of the accident. Obviously, the weapon fell out of the Holster. This « non -careful handling of the weapon » was the mistake of his client. This could not say exactly how the process was – just so much: « He caught the gun and just wrapped it tightly. » He justified the partly contradictory information from the 20-year-old that he was unable to « express himself rhetorically well ».
