16-year-old girl is on trial for spreading nude photo of Daan (14) who stepped out of life: « Wanting to signal that bullying is not possible » (Waregem)

On January 9, 2023, Daan left life after continuous bullying behavior. The public prosecutor investigated the case for two years, but in the end only a 16-year-old girl for the juvenile judge has to appear because she sent a nude photo of Daan. Other possible bullies remain out of the shot for the time being and according to the public prosecutor there is no causal link between forwarding the photo and the death of Daan.

On Friday the trial was introduced against the girl, but it was immediately postponed to May 16. The problem is that the case is not yet ready. « For us, this Liège is inextricably linked to the criminal part, » says lawyer Thomas Vandemeulebroucke. “After all, there is no such thing as sending a nude photo With death as a resultwhile the causal relationship between them is obvious for us. « 

“The only way to demonstrate this is if the court judges that my clients' civil damage is related to the mistakes that the minor defendant made. They are actually entitled to a high compensation but only a symbolic euro. The only thing that counts for them is that the causal link is demonstrated. Insecurity

Lawyer Stijn Dewolf, who assists the girl that sent the photo, regrets that the case was postponed. « My client had hoped it differently, at the age of 13 she made a mistake and three years later she still lives in uncertainty. We still regret that the lawyer of Daan's parents wants to hold my client liable for his death. »

The case will therefore not be continued until 16 May. In the meantime, Master Vandemeulebroucke is planning to sue the parents of three alleged bullies before the civil court.
